LOW TRAFFIC NEIGHBOURHOODS
THE NEWHAM (FAIRLAND ROAD, HAM PARK ROAD, MARGERY PARK ROAD, TAVISTOCK ROAD AND VICARAGE ROAD) (LOW TRAFFIC NEIGHBOURHOOD) EXPERIMENTAL TRAFFIC ORDER 2024
1. NOTICE IS HEREBY GIVEN that the Council of the London Borough of Newham on 21 October 2024 made the above-mentioned Order under Section 9 of the Road Traffic Regulation Act 1984, as amended.
2. The general effect of the Order will be to introduce road closures, compulsory turning movements, suspend certain existing parking controls and waiting and loading restrictions for the duration of the experimental order and replace them with the restrictions detailed below:
a) road closures (except for virtual access permit holders WHP01) and compulsory turns. Enforcement will be via the use of CCTV at:-
i. Ham Park Road,
a. at the eastern kerb-line of Margery Park Road, requiring eastbound traffic on Ham Park Road to make a compulsory left turn into Margery Park Road and for southbound traffic on Margery Park Road to make a compulsory right turn into Ham Park Road;
b. at the common boundary of Nos. 63 and 65 Ham Park Road;
ii. Tavistock Road, at its junction with Vicarage Road; and
iii. Vicarage Road, at its junction with Fairland Road.
b) conversion of short lengths of existing parking places to no waiting and no loading at any time restrictions in:-
i. Fairland Road, the south-west side outside No. 47 Fairland Road;
ii. Ham Park Road, the south side opposite Nos. 173 and 175 Ham Park Road;
iii. Tavistock Road, the south-west side, parking place closest to Vicarage Road junction; and
iv. Vicarage Road; both sides, parking places closest to Fairland Road junction adjacent to Nos. 45 and 47 Fairland Road.
c) conversion of lengths of existing waiting restrictions to no waiting and no loading at any time in: -
i. Fairland Road, the south-west side, at its junction with Vicarage Road between the parking places;
ii. Ham Park Road, both sides, between the north-eastern flank wall of No. 66 Ham Park Road and the western back wall of No. 67 Fairland Road, and outside and opposite Nos. 173 and 175 Ham Park Road;
iii. Tavistock Road, both sides, from its junction with Vicarage Road adjacent to Nos. 41 and 43 Vicarage Road; and
iv. Vicarage Road; both sides, from its junction with Fairland Road adjacent to Nos. 45 and 47 Fairland Road and at its junction with Tavistock Road outside and opposite Nos. 39 to 43 Vicarage Road.
3. Exemptions to the road closures will also apply to:
(a) pedal cycles;
(b) Newham Passenger Transport motor vehicles whilst undertaking statutory obligations for the transport of a person with a special education need and disability;
(c) refuse collection vehicles; and
(d) vehicles being used: (i) for ambulance, fire brigade or police purposes; (ii) in the service of the local authority for the purpose of collecting refuse or street cleansing; (iii) in connection with the removal of any obstruction to traffic; (iv) in connection with the maintenance, improvement or reconstruction of the highway; (v) in connection with the placing, maintenance, improvement, reconstruction or removal of any street furniture including bus stop infrastructure; or (vi) for the provision of a universal postal service.
4. A holder of a valid disabled person’s blue badge will be eligible to register one nominated motor vehicle, without charge, for a WHP01 virtual (electronic) access permit for the addresses specified in Schedule 1 to this notice; and those addresses will apply to Newham Passenger Transport motor vehicles whilst undertaking statutory obligations for the transport of a person with a special education need and disability.
5. Whilst the road closures in Ham Park Road and Vicarage Road are in place H7 virtual (electronic) access permits to the ‘Park Primary – pedestrian and cycle zone’ will be extended / granted without charge to those occupiers who keep vehicles at addresses specified in Schedule 2 to this notice.
6. The Order, which will come into force on 4 November 2024, and other documents giving more detailed particulars of the Order are available for inspection during normal office hours on Monday to Friday inclusive at Newham Dockside, 1000 Dockside Road E16 2QU, by telephoning 020 3373 6415 or by emailing traffic.orders@newham.gov.uk until such time as the Order ceases to have effect.
7. If any person wishes to question the validity of any of the Order or of any of its provisions on the grounds that it are not within the powers conferred by the Act, or that any requirement of the Act or of any instrument made under the Act has not been complied with, that person may, within six weeks from the date on which the Order is made, apply for the purpose to the High Court.
8. If the provisions of any or all of the Order continue in force for a period of not less than six months, the Council will be considering in due course whether the provisions of any or all of the experimental Order should be continued in force indefinitely by means of an Order or Orders under Sections 6 and/or 45 of the said Act of 1984.
9. Within a period of six months –
(a) beginning with the day on which the experimental Order came into force, or
(b) if that Order is varied by another Order or modified pursuant to Section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force;
any person may object to the making of Orders for the purpose of such indefinite continuation.
10. All objections and other representations relating to the continuation of the Order must be made in writing. All objections must specify the grounds on which they are made. They should be sent to the Director of Highways, Parking & Transportation, London Borough of Newham, 3rd Floor West, Newham Dockside, 1000 Dockside Road, London E16 2QU or by email, quoting the Order title, to: traffic.orders@newham.gov.uk
11. Under the requirements of current access to information legislation, any letter or e-mail sent to the Council in response to this Notice may be subject to publication or disclosure, or both, including communication to other persons affected.
