Notice is hereby given pursuant to an Order of District Judge Salmon in the High Court of Justice, Chancery Division, Birmingham District Registry dated 11 April 2016 (the “Order”) that:

1. Ian Michael Pankhurst (the “Respondent”) be removed from office as Administrator, Liquidator, Trustee in Bankruptcy or Supervisor (as the case may be) in respect of each of the matters referred to below in which he holds such office and Alisdair James Fraser Findlay (the “Applicant”), being a licensed insolvency practitioner (office holder number: 1226) of Findlay James (Insolvency Practitioners) Limited, Saxon House, Saxon Way, Cheltenham, GL52 6QX, be appointed in place of the Respondent as the sole Administrator, Liquidator, Trustee in Bankruptcy or Supervisor (as the case may be) in respect of each of the following matters, in each case with immediate effect:

2. The Applicant shall give notice of the Order to all creditors of the estates listed above within twenty-eight days form the date of the Order, either by letter or by means of an advertisement in the London Gazette.

3. The Applicant shall notify the Secretary of State of the Order as soon as reasonably practicable after it is made.

4. All creditors of the estates listed above do have permission to apply to the court on notice to the Applicant within twenty-eight days of notice mentioned above for the purposes of applying to vary or discharge the Order insofar as it effects the company or companies or individual’s estate of which they are a creditor. However, such application shall not affect the transfer of the insolvency appointments by the Order until further or other order of the court.

5. The Respondent shall receive his release as Trustee, Liquidator and Supervisor and be discharged from liability as Administrator (in respect of the companies identified above) with effect from fourteen days after the advert is placed in the London Gazette, save that such release may be subject to further order in the event of an application by any creditor as referred to above for the specific case subject to that application.

6. The Applicant will attend to all and any necessary reports to creditors (subsequent to the date of the Order) required under the Insolvency Rules 1986, the cost of which will be charged as a cost or expense of the estates listed above (each estate to bear an equal share, but with no estate having to bear an amount exceeding ten percent of the available funds in that estate).

7. The Applicant’s costs of the application be charged as a cost or expense of the estates listed above (each estate to bear an equal share, but with no estate having to bear an amount exceeding ten percent of the available funds in that estate).

8. The Applicant must ensure that a sealed copy of the Order is lodged with each court having jurisdiction over the respective matters referred to above for filing on the court file relating to that case.
