The Transport and Works Act 1992

The Transport and Works (Applications and Objections Procedure) (England and Wales) Rules 2006

Proposed Network Rail (Closure of Abbots Ripton Level Crossing) Order

Network Rail Infrastructure Limited (“Network Rail”) of 1 Eversholt Street, London, NW1 2DN, has applied to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992, for the above-mentioned Order under sections 1 and 5 of that Act.

The Order would confer powers on Network Rail to close the Abbots Ripton level crossing, to stop up the existing bridleway over the railway and to provide a new, alternative, bridleway route in substitution.

The Order would also confer powers for the construction and maintenance of works in connection with the extinguishment and creation of the bridleways, and for the temporary use of land for those purposes. The Order would extinguish any rights of way over the crossing and provide for compensation to be paid for any person who suffers loss as a result of the extinguishment of a private right of way. It would also apply the compensation provisions of the Highways Act 1980 to the creation of the new bridleway.

The Secretary of State has determined that the application is not to be made subject to an environmental impact assessment.

The application contains a statement that a direction for deemed planning permission is being applied for.

Any objections to, or other representations about, the proposals should be sent to the Secretary of State for Transport c/o Transport and Works Act Orders Unit, General Counsel's Office, Department for Transport, Zone 1/18, Great Minster House, 33 Horseferry Road, London SW1P 4DR, email transportandworksact@dft.gsi.gov.uk.
