Proposed Network Rail (Cambridgeshire Level Crossing Reduction) Order

NOTICE OF APPLICATION FOR AN ORDER

Network Rail Infrastructure Limited (“Network Rail”) of 1 Eversholt Street, London, NW1 2DN, is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992, for the above-mentioned order under sections 1 and 5 of that Act.

This Order confers powers on Network Rail to close or downgrade the following level crossings:

In the District of Fenland:

• Parish of Whittlesey: C15 Brickyard Drove and C14 Eastrea Cross Drove;

• Parish of March: C13 Middle Drove and C12 Silt Drove;

In the District of East Cambridgeshire:

• Parish of Downham: C11 Furlong Drove and C10 Coffue Drove;

• Parish of Ely: C09 Second Drove, C24 Cross Keys, C16 Prickwillow 2, C17 Prickwillow 1, C08 Ely North Junction, C22 Wells Engine and C21 Newmarket Bridge;

• Parish of Littleport: C25 Clayway, C26 Poplar Drove, C27 Willow Road/Willow Row and C28 Black Horse Drove;

• Parish of Soham: C20 Leonards;

• Parish of Fordham: C18 Munceys;

• Parish of Thetford: C03 West River Bridge;

• Parish of Stretham: C02 Nairns No.117;

• Parish of Westley Waterless: C30 Westley Road;

In the Districts of East Cambridgeshire and South Cambridgeshire:

• Parishes of Brinkley and Little Wilbraham: C29 Cassells;

In the District of South Cambridgeshire:

• Parish of Waterbeach: C33 Jack O’Tell (Adam’s Crossing), C01 Chittering, C34 Fysons and C35 Ballast Pit;

• Parish of Harston: C07 No.37;

• Parish of Meldreth; C04 No.20.

In relation to these closures or downgrades the Order authorises in the County of Cambridgeshire, Districts of Fenland, East Cambridgeshire and South Cambridgeshire and in the County of Suffolk, District of Forest Heath, the carrying out of works including the removal of the crossings and the diversion or redesignation of the status of certain footpaths, public roads, bridleways, restricted byways or byways open to all traffic and the creation of new rights of way. The Order also authorises the construction of the following specific works in connection with the creation of new public rights of way:

• In the District of Fenland, Parish of Whittlesey: Works Nos 1 and 2 (footbridges carrying paths over a drain/watercourse);

• In the District of East Cambridgeshire, Parish of Ely: Works Nos 3, 4 and 5 (footbridges carrying paths over a drain/watercourse);

• In the District of East Cambridgeshire, Parish of Littleport: Work No 6 (bridge carrying bridleway over a drain/watercourse);

• In the District of East Cambridgeshire, Parish of Soham: Work No 7 (footbridge carrying path over a drain/watercourse); and

• In the District of South Cambridgeshire, Parish of Waterbeach: Works Nos 8 and 9 (footbridges carrying paths over a drain/watercourse).

The Order also authorises alteration to the highway at Station Road/Lynn Road in the District of East Cambridgeshire, Parish of Littleport adjacent to C31 Littleport Station.

The Order also confers powers for the construction and maintenance of works, including the creation of new rights of way; provides for compensation to be paid for any person who suffers loss as a result of the extinguishment of a private right of way; applies the compensation provisions of the Highways Act 1980 to the creation of new rights of way; permits Network Rail to acquire land and interests in land, including the temporary use of land, in connection with the construction of the scheduled and authorised works; authorises the permanent and temporary stopping up of streets; works in streets, traffic regulation; and related purposes.

This application is not made subject to an environmental impact assessment.

The application contains a statement that a direction for deemed planning permission is being applied for.

An objection or representation MUST (i) be received by the Secretary of State on or before 25 April 2017, (ii) be made in writing (whether sent by post or email), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent. (If you are sending your objection or other representation by e-mail, please provide a postal address and state “Network Rail Cambridgeshire Level Crossing Reduction Order” in the subject of the email.)

The Secretary of State may make complete copies of the objections and other representations public, including any personal information in them, and will copy them to the applicant for the Order.
