THE RADIOACTIVE SUBSTANCES ACT 1993 (AS AMENDED)
Notice is hereby given that joint applicants, under section 16A of the above Act, have been made by British Energy Generation (UK) Limited and British Energy Generation Limited to the Scottish Environment Protection Agency (SEPA) for the transfer of authorisations held under section 13, of the above Act, by British Energy Generation (UK) Limited to British Energy Generation Limited. The authorisations subject to the applications relate to the disposal of radioactive waste from the premises at Hunterston ‘B’ Power Station, West Kilbride, Ayrshire KA23 9QJ, and Torness Power Station, Dunbar, East Lothian EH42 1QS. The applications relate to the transfer of authorisations between operators and, if granted, no change will be made to the conditions and limitations of the authorisations.
In accordance with the requirements of section 16A(5) of the above Act, SEPA is consulting with relevant public and local authorities.
In addition, the application may be viewed on the SEPA website (www.sepa.org.uk) or inspected by any interested party between 9.00 am and 5.00 pm at the following SEPA offices:
For Hunterston ‘B’ only
1. SEPA East Kilbride Office, 5 Redwood Crescent, Peel Park, East Kilbride G74 5PP
2. SEPA Ayr Office, 31 Millar Road, Ayr KA7 2AX
For Torness only
3. SEPA Edinburgh Office, Clearwater House, Heriot-Watt Research Park, Avenue North, Riccarton, Edinburgh EH14 4AP
In determining the applications, SEPA will consider:
(a) whether the proposed transferee has or will have operational control over the radioactive disposals to which the transferred authorisation will relate;
(b) whether the proposed transferee is able and willing to ensure compliance with the limitations and conditions of the authorisation that he will hold if the application is granted; and
(c) whether any other grounds exist on which it would be reasonable to refuse to grant the transfer application.
Written representations for Hunterston ‘B’ may be made to The Registrar, SEPA East Kilbride Office and for Torness to The Registrar, SEPA Edinburgh Office and, if received before 7 April 2005, will be considered by SEPA when determining the transfer applications. Comments are invited on the understanding that they may be made public by SEPA. Comments will only be treated as “not for publication” if a specific request to that effect is made to SEPA.
