NOTICE OF APPLICATIONS FOR CONSENT IN PURSUANCE OF SECTION 34

Notice is hereby given, in accordance with section 36(1)(a) of the Control of Pollution Act 1974 (As Amended), that the following applications have been made to SEPA by ATH Resources Plc for consent to discharge trade effluent and surface water from Laigh Glenmuir Opencast Coal Site, Laigh Glenmuir Farm, Near Cumnock, Ayrshire:

Ref: WPC/W/72935

Up to 5685m3 per day of treated trade effluent to the Glenmuir Water at NGR

NS 6150 2030.

Ref: WPC/W/72958

Up to 1200m3 per day of any other matter, namely treated surface water, to

the Glenmuir Water at NGR NS 6225 1998.

Any person who wishes to make representations about the applications should do so in writing to The Registrar, SEPA, 5 Redwood Crescent, Peel Park, East Kilbride G74 5PP, not later than 15 November 2005, quoting the appropriate reference number.

Copies of the applications may be inspected, free of charge, at the above address between 9.30 am and 4.30 pm Monday to Friday (except local and national holidays) and by prior arrangement at the Local Office, 31 Miller Road, Ayr KA7 2AX (Tel. 01292 294000).
