The Barnet (Prescribed Route) (No. 1) Experimental Order 1998

Notice is hereby given that the Council of the London Borough of Barnet have made on 7th January 1998 the above-mentioned Order unders sections 9 and 124 of and Schedule 9 to the Road Traffic Regulation Act 1984.   2. The general effect of the Order will be to ban traffic travelling in a south-westerly direction along The Broadway, Mill Hill from turning right into the Marks and Spencers car park.   3. The prohibitions referred to in paragraph 2 above will not apply in relation to anything done:   (a) with the permission or at the direction of a police constable in uniform;   (b) in accordance with traffic signs placed pursuant to section 66 or section 67 of the Road Traffic Regulation Act 1984;   (c) in relation to any vehicle being used for ambulance, fire brigade or police purposes in an emergency.   4. The Order provides that, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Chief Executive of the Council or some person authorised in that behalf by him, may, if it appears to him essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which any road affected by the Order runs, modify or suspend the operation of the Order or any provision thereof.   5. A copy of the Order, which will come into operation on Monday, 19th January 1998, a plan of the scheme, the Council’s statement of reasons for making the Order and for proceeding by way of experiment and whether the Council intend to consider making a permanent Order in like terms, can be inspected on Mondays to Fridays inclusive between 9 a.m. and 5 p.m. (Bank Holidays excepted), until the expiration of a period of six months from that date at (a) Traffic Section Room 1006, Barnet House, 1255 High Road, Whetstone N20 0EJ and (b) The Town Hall, The Burroughs, Hendon NW4 4BG.   6. Any person wishing to question the validity of the Order or of any of its provisions on the grounds that it is not within the powers of the Road Traffic Regulation Act 1984 or that any of the requirements thereof or of any relevant regulations made thereunder have not been complied with in relation to the Order may, within 6 weeks from the date on which the Order was made, make application for the purpose to the High Court.   7. If the provisions of the Order continue in operation for a period of not less than 6 months, the Council will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of Order under section 6 of the said Act of 1984. Anyone who wishes to object to the making of such Order for the purposes of such reproduction and continuation in force may, within the period of 6 months referred to above, send a statement in writing of their objection and the grounds thereof to the Director of Environmental Services, Barnet House, 1255 High Road, Whetstone, London N20 0EJ.
