The Council of the London Borough of Southwark (Prescribed Routes) (Experimental) No.1) Traffic Order 1998

Notice is hereby given in accordance with The Local Authorities Traffic Orders (Procedure) (England and Wales) Regulations 1996, that the Council of the London Borough of Southwark proposes to make the above-mentioned Order under sections 9 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985.   2. The general effect of the Order would be to proceed by way of experiment:       (a) to close the junction of the southern arms of Friern Road and Upland Road (at its northernmost point) to vehicular traffic;       (b) to cause all vehicles entering or proceeding in Henslowe Road to travel in a southerly direction.   3. Exemptions to Article 2(a) above would be provided in respect of anything done:       (a) in relation to a pedal cycle;       (b) in relation to any vehicle being used for ambulance, fire brigade or police purposes in an emergency entering that part of the prohibited area;       (c) with the permission or at the direction of a Police Constable in uniform; or       (d) to any person who causes any vehicle to proceed in accordance with any restriction or requirement indicated by traffic signs placed pursuant to section 66 or 67 of the Road Traffic Regulation Act 1984.   The Orders provide that in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, the Traffic Group Manager or some other person authorised in that behalf, by him, may, if it appears to him or that person essential in the interests of the expeditious, convenient and safe movement of traffic or for preserving or improving the amenities of the area through which the road affected by the Order runs, modify or suspend the Order or any provision thereof.   A copy of the proposed Order, which will come into operation on 26th January 1998, of a plan and of the Council’s statement of reasons for making the Order and proceeding by way of experiment can be inspected during normal office hours on Mondays to Fridays inclusive, until the expiration of a period of 18 months from the date on which this notice is published in the Council Offices, Chiltern House, Portland Street, London SE17 2ES.   Further information may be obtained from Matt Kent, Southwark Regeneration & Environment, Council Offices, Chiltern House, Portland Street, London SE17 2ES. Tel: (0171) 525 5468.   If the provisions of the Order continue in operation for a period of at least 6 months, the Southwark Borough Council will consider in due course whether the provisions of the Order should be reproduced and continued in force indefinitely by means of an Order under section 6 of the said Act of 1984.   Within a period of 6 months from the coming into force of the Order or if the Order is subsequently varied by another Order under section 9 or modified pursuant to sub-section (2) of section 1 of the 1984 Act from the coming into operation of that variation or modification (whichever is the latest), any person may object to the making of the Order for the purposes of such indefinite continuation and should send a statement in writing of their objection and grounds thereof to the Director of Regeneration & Environment, Council Offices, Chiltern House, Portland Street, London SE17 2ES, quoting Ref: PR/CQ/T1.2-251.   Any person desiring to question the validity of the Order or of any provisions contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant regulations made thereunder has not been complied with in relation to the Order may, within 6 weeks of the date on which the Order was made, make application for the purpose to the High Court.
