TOWN AND COUNTRY PLANNING ACT 1990

Stopping-up of a length of the B3193 Chudleigh to Christow Road (adjoining Trusham Quarry) in the Parish of Hennock, near Chudleigh, Devon. The Secretary of State for the Environment, Transport and the Regions, hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Devon) (No. SW 1) Order 1998” authorising the stopping-up of a length of the B3193 Chudleigh to Christow road (adjoining Trusham Quarry), in the Parish of Hennock, near Chudleigh, Devon, to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission referred to in that Schedule, and requiring the provision of a new highway along the route shown by stipple on the deposited plan, maintainable at the public expense for which the Devon County Council will be the local highway authority.
  Copies of the Order may be obtained, free of charge, on application to the Government Office for the South West (Transport), 5th Floor, The Pithay, Bristol BS1 2PB (quoting Ref. GOSW(T) 5051/35/1/299) and may be inspected at all reasonable hours at the offices of Teignbridge District Council, Forde House, Brunel Road, Newton Abbot, Devon TQ12 4XX.
  Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the grounds that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may within 6 weeks of 28th February 1998 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.

The realignment of the Christow to Chudleigh road, replacement of existing aggregate processing and coating plant and construction of a landscaped bank at Trusham Quarry, in the Parish of Hennock, near Chudleigh, Devon, in accordance with planning permission granted to ARC Ltd., by Devon County Council, on 21st October 1997, under Ref. 5.21.3257.96.
