RAILTRACK (WEST COAST MAIN LINE) ORDER

Notice is hereby given that Railtrack PLC (“Railtrack”) is applying to the Secretary of State for the Environment, Transport and the Regions, Department of the Environment, Transport and the Regions, TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR, for an Order under section 1 of the Transport and Works Act 1992. The following is a concise summary of the purposes of the Order for which application is being made: 1. To empower Railtrack to construct the following works: In the county of Northamptonshire, district of South Northamptonshire: Works Nos. 1, 1A and 1B—A realignment of Banbury Lane at Banbury Lane level crossing and associated road junctions, including the construction of bridges over the railway and the Grand Union Canal. In the county of Northamptonshire, district of Daventry: Work No. 2—A pedestrian underpass beneath the railway at Welton. In the city of Coventry: Work No. 3—A combined cycle/footbridge over the railway at Canley Road level crossing. Works Nos. 4, 4A, 5 and 6—A realignment of Cromwell Road and Station Avenue at Tile Hill level crossing including the construction of bridges over the railway, a new road and a private access, a realignment of Duggins Lane, a partial diversion of Station Avenue and a new road between Alan Higgs Way and the realigned Cromwell Road. Work No. 7—A footbridge over the railway at Tile Hill station. In the county of Warwickshire, borough of Rugby: Work No. 12—A railway (7,555 metres in length) being a fourth track on the course of the existing railway between Rugby and Brinklow, commencing by a junction with the London to Birmingham Section of the West Coast Main Line at Bridge 281 and terminating by a junction with the Rugby to Stafford Section of that line at Fosse Way including the partial reconstruction of certain bridges along the railway and the provision of a drainage outfall into the Oxford Canal. Work No. 13—A reconstruction of the bridge carrying the Little Lawford to Harborough Magna road over the railway. Work No. 14—A replacement footbridge, Bride No. 11a, over the Rugby to Stafford Section of the railway. In the county of Warwickshire, borough of Nuneaton and Bedworth: Work No. 15—A railway (1,015 metres in length) on the course of the existing railway at Attleborough commencing by a junction with the Rugby to Stafford Section of the West Coast Main Line between Gipsy Lane and Lutterworth Road. Work No. 16—A railway (1,185 metres in length) commencing by a junction with the Nuneaton to Leicester Railway between Whiteacre Road and Leicester Road terminating by a junction with the Rugby to Stafford Section, including an underpass beneath the Rugby to Stafford Section and a junction with Work No. 16B. Work No. 16A—A diversion of the river Anker near Whiteacre Road. Work No. 16B—A realignment (547 metres in length) of the Nuneaton to Coventry Railway between Attleborough Road and Leicester Road including retaining walls. Work No. 16C—A lowering of the underpass beneath the Rugby to Stafford Section and the Nuneaton to Leicester and Coventry Railways and a diversion of the footway between Oaston Road and Wheat Street. Work No. 17—A railway (1,545 metres in length) between Leicester Road and Midland Road, including the provision of a platform and station footbridge at Nuneaton station, a maintenance depot and retaining walls. Work No. 17A—A realignment of Weddington Terrace. In the Metropolitan Borough of Solihull: Work No. 8—A pedestrian and cycle underpass beneath the railway between Station Road and Truggist Lane at Berkswell level crossing. Work No. 9—A footpath, including a footbridge over Station Road at Berkswell level crossing. Work No. 10—A realignment of Truggist Lane underpass. Work No. 11—A realignment of a brook beneath Truggist Lane. In the county of Staffordshire, borough of Tamworth: Work No. 18—A footbridge over the Rugby to Stafford Section of the West Coast Main Line at footpath FP T11. In the county of Staffordshire, district of Lichfield: Work No. 19—A footbridge over the Rugby to Stafford Section of the West Coast Main Line at footpath FP 22. Works No. 20, 20A and 20B—A realignment of Fisherwick Road and the C75 at Hademore level crossing including the construction of a bridge over the Rugby to Stafford Section of the railway, the provision of an accommodation road and associated road junctions. Work No. 21A—A railway (422 metres in length) on the course of the existing railway, commencing and terminating by junctions with the northern track of the Rugy to Stafford Section, between the A38 trunk road and Burton Old Road. Work No. 21B—A railway (420 metres in length) on the course of the existing railway, commencing and terminating by junctions with the southern track of the Rugby to Stafford Section, between the A38 trunk road and Burton Old Road. Work No. 22—A railway (8,525 metres in length) on the course of the existing railway, between Burton Road (A5127) and footpaths FP 17 and FP 26 where they meet between the River Trent and the Trent and Mersey Canal including the demolition and reconstruction of bridges. Work No. 23—A footbridge over the Rugby to Stafford Section at footpaths FP 10 and FP 1. Works No. 24, 24A and 24B—A realignment of Netherstowe Lane over the Rugby to Stafford Section including the construction of a bridge, the provision of an accommodation road and associated road junctions. Work No. 25—A footbridge over the Rugby to Stafford Section at footpath FP 8. Work No. 26—A footbridge over the Rugby to Stafford Section at footpath FP 10. Work No. 27—A footbridge over the Rugby to Stafford Section at footpath FP 13. Works Nos. 28 and 28A—A new road, being a realignment of Fog Lane and an accommodation road from Fog Lane to a junction with the private road north-west of Tomhay Wood Farm. Works Nos. 29 and 29A—A realignment of Tewnals Lane (A515) over the Rugby to Stafford Section including the construction of a bridge and a realignment of Wood End Lane at its junction with Tewnals Lane. Work No. 30—A realignment of Shaw Lane over the Rugby to Stafford Section including an accommodation road. Works Nos. 31 and 31A—A realignment of Lichfield Road (B5015) over the Rugby to Stafford Section and a realignment of Uttoxeter Road at its junction with Lichfield Road. 2. To authorise Railtrack to carry out and maintain works and provide facilities on specified land with all necessary works and conveniences as follows: In the county of Hertfordshire, borough of Dacorum, the provision of pressure relief shafts at Northchurch, the provision of electrical equipment at Nash Mills, Bourne End, Dudswell and Bulbourne; district of Three Rivers, the provision of electrical equipment at Gypsy Lane. In the London Borough of Brent, the provision of electrical equipment at Kenton. In the London Borough of Harrow, the provision of electrical equipment at Hatch End. In the county of Buckinghamshire, district of Aylesbury Vale, the provision of electrical equipment at Chelmscote. In the borough of Milton Keynes, the provision of electrical equipment adjacent to the A5 trunk road and the railway near Chaffron Way. In the county of Northamptonshire, district of South Northamptonshire, the provision of pressure relief shafts at Stowehill, the provision of electrical equipment, the closure of Bugbrooke level crossing and the diversion of footpath FP KD18 at Bugbrooke, the closure of Banbury Lane level crossing and the temporary closure of a specified part of the Grand Union Canal; district of Daventry, the provision of pressure relief shafts at Stowehill, provision of electrical equipment at Kilsby Tunnel, Althorp Park, Long Buckby and Crick and the closure of the level crossing and diversion of footpath FP EA8 at Welton; borough of Northampton, the provision of electrical equipment at Northampton. In the city of Coventry, the closure of the Canley Road level crossing and the Tile Hill level crossing and the provision of vehicular turning area, station car park and traffic management system at Canley station. In the county of Warwickshire, borough of Rugby, the provision of oil separators and accesses, the closure of the level crossings at Brandon and Combe Fields and the diversion of footpaths, FP R145 at Brandon, FP 117 at Cathiron Lane, FP R70s at Brinklow Road and FP R73h at Combe Fields and the temporary closure of a specified part of the Oxford Canal; borough of North Warwickshire, the provision of electrical equipment at Hartshill; borough of Nuneaton and Bedworth, the provision of access at Attleborough and the provision of drainage and access at Nuneaton. In the Metropolitan Borough of Solihull, the closure of Berkswell level crossing and control of vehicles using Berkswell under-pass; the closure of Wootton Green level crossing and Bradnocks Marsh level crossing, the diversion of footpath FP M144A at Wootton Green, the diversion of footpath FP 215a and the provision of a footbridge at Bradnocks Marsh and the diversion of footpath FP M107 at Bickenhill. In the city of Birmingham, the diversion of footpath FP 5 at Mackadown Lane. In the county of Staffordshire, borough of Tamworth, the provision of accommodation access at Comberford Hall and the diversion of footpath FP T11 at Alders; district of Lichfield, the closure of Hademore level crossing, the provision of vehicle turning areas and drainage and the relocation of listed gate posts at Hademore Road, the relocation of electricity pylon and cables, the diversion of footpaths FP 9, FP 7, FP 6, FP 8 and FP 13 between Lichfield and Armitage, road realignment, the provision of electrical equipment and access in connection with the Lichfield-Armitage Quadrupling, the provision of electrical equipment at Fisherwick and the temporary closure of a specified part of the Trent and Mersey Canal; borough of Stafford, the provision of access at Colwich, the provision of electrical equipment at Walton, Seighford, Millmeece and Stableford, the closure of footpath FP 39 over Doxey level crossing and footpath FP 5 over Norton Bridge level crossing, the closure of Comberford Hall level crossing and the diversion of footpath FP 22, the closure of Elmhurst South level crossing and the diversion of footpath FP 10, the closure of Elmhurst North level crossing and the diversion of footpath FP 13, the closure of Pasturefields level crossing and the diversion of Pasturefields Lane footpath, the closure of Highfields level crossing and the diversion of Sandy Lane footpath, the closure of Gayton Brook level crossing and the diversion of footpath FP 2, the closure of Burton Lodge level crossing and the diversion of footpath FP 35; borough of Newcastle-under-Lyme, the closure of footpaths FP 4a, FP 4b and FP 5 over Chatterley Farm level crossing. In the county of Cheshire, borough of Vale Royal, the diversion of footpath FP 5 at Acton Bridge; borough of Congleton, the closure of the level crossing and the diversion of footpath FP 68 at Wood Farm and the closure of the level crossing and the diversion of footpath FP 2 at Dunkirk Farm; borough of Macclesfield, the closure of Macclesfield Moss and Gaw End Lane level crossings and diversion of footpaths FP 5 and FP 1 and provision of footbridges at Danes Moss, the closure of Prestbury North level crossing and the diversion of footpath FP 11 and provision of footbridge at Bradley Mount. In the borough of Halton, the closure of Preston Brook level crossing and the extinguishment of accommodation rights over that crossing at Keckwick. In the Metropolitan Borough of Stockport, the closure of Cheadle Hulme level crossing and the diversion of footpath FP 104. In the Metropolitan Borough of Wigan, the closure of level crossings at Rylands and Standish and the diversions of footpaths FP 35 and FP 20 respectively. In the county of Lancashire, borough of Wyre, the closure of Bilsborrow level crossing and the diversions of footpaths FP 2 and FP 3, the closure of Claughton level crossing and the diversion of footpath FP 5 at Claughton, the closure of Woodacre level crossing and the diversion of footpath FP 3 and provision of footbridge at Woodacre; city of Lancaster, the closure of Galgate level crossing and the diversion of footpaths FP 2 and FP 15 and provision of footbridge at Galgate and the closure of footpath FP 16 over Yealand Steps level crossing. In the county of Cumbria, district of South Lakeland, the closure of Holme level crossing and the diversion of footpath FP 504012, the closure of Milnthorpe level crossing and the diversion of footpath FP 556007, the closure of Well Heads level crossing and the diversion of footpath FP 532009, the closure of Raines Hall level crossing and the diversion of footpath FP 569002, the closure of Natland level crossing and the diversion of footpath FP 557008, the closure of Lambrigg 1 and Lambrigg 2 level crossings and the diversion of footpaths FP 546007 and FP 546005 respectively and the closure of Grayrigg level crossing and the diversion of footpath FP 527016; district of Eden, the closure of footpath FP 361026 over Shap Summit level crossing. In the city of Carlisle, the closure of Garriestown level crossing and the diversion of footpath FP 128005. 3. To empower Railtrack to construct and maintain ancillary works in connection with or in consequence of the above-mentioned works. 4. To provide for the compulsory acquisition or use of lands and rights over lands for or in connection with the intended works; the temporary possession of land for or in connection with the carrying out of works; the extinction or suspension of private rights of way over land. 5. For the purposes of the proposed works, to authorise the execution of street works, the permanent and temporary stopping-up of certain streets, the provision of access to works, the construction and maintenance of new or altered streets; the making of agreements with street authorities with respect to streets, bridges and tunnels; the discharge of water in connection with the construction and maintenance of the proposed works; the carrying out of protective works to certain buildings; and the surveying and investigation of land. 6. To confer further powers and to make other provision incidental or supplemental to, consequential upon or in connection with the above-mentioned purposes, including the incorporation, modification, application and disapplication of certain enactments. And notice is further given that: (a) In respect of the development described above application is being made to the Secretary of State for deemed planning permission; (b) A waiver direction has been given by the Secretary of State in respect of certain provisions of the Transport and Works (Applications and Objections Procedure) Rules 1992 and is included in the documents submitted with the application; (c) Any person may object to the making of the Order by giving notice in writing in the period from 29th February 2000 to 11th April 2000, to the Secretary of State for the Environment, Transport and the Regions, Department of the Environment, Transport and the Regions, c/o TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR. Such objections must arrive not later than 11th April 2000. An objection will not be valid unless (i) it is received by the due date, (ii) is made in writing, (iii) states the grounds of objection, and (iv) gives the objector’s name and address.
