Highway at Plots 1-38 Cherrybrooke Close, Hope-under-Dinmore, Leominster

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Herefordshire) (No. 1) Order 1998” authorising the stopping-up of areas of highway at Cherrybrooke Close, Hope-under-Dinmore, and requiring the provision of new highway shown as stippled on the deposited plan and the improvement of existing highway shown as cross hatched on the deposited plan.   The Order as made, will authorise the stopping-up only to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted by Leominster District Council on 26th September 1997 under Ref. 97/0521/N.   Copies of this Order may be obtained, free of charge, on application to the Government Office for the West Midlands at the offices of the Director, Planning, Transport and the Environment, 77 Paradise Circus, Queensway, Birmingham B1 2DT (quoting 5058/35/1/23) and may be inspected at all reasonable hours at the offices of the Planning Department, Herefordshire Council, PO Box 43, Lion House, Broad Street, Leominster HR6 8ZE.   Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the grounds that it is not within the powers of the above Act, or that any requirement of that Act, or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 14th May 1998, apply to the High Court for the suspension or quashing of the Order, or of any provision contained therein.
