INSOLVENCY ACT 1986
NOTICE OF REMOVAL AND APPOINTMENT
Notice is hereby given that pursuant to an Order of the High Court of Justice, Leeds District Registry No. OLS30343 dated 21 May 2010, Jonathan Paul Philmore, previously of RSM Tenon Recovery, Unit 1 Calder Close, Calder Park, Wakefield WF4 3BA has been removed as Office Holder in the insolvency matters listed below and has been replaced by:
William Duncan and/or Sarah Louise Burge, both of RSM Tenon Recovery, Unit 1 Calder Close, Calder Park, Wakefield WF4 3BA.
Creditors/members have liberty to apply, within 28 days after this notice has been advertised, to vary or discharge the Order made.
Where a liquidation committee has been appointed, it is open to the committee to require the replacement office holders or those office holders remaining in office to provide an account of the administration of the winding up pursuant to the Insolvency Rules 1986 r.4.108(3), including a summary of the receipts and payments and a statement that he as reconciled his accounts.
Where no liquidation committee has been appointed, it is open to any creditor of a liquidation in the schedule to apply for an order that the replacement office holders do provide such information as they might otherwise be required by the Insolvency Rules 1986 r.4.108(3), that is to say an account of the administration of the winding up including a summary of the receipts and payments and a statement that he has reconciled his accounts.
If the replacement office holders have been required to provide the information referred to above, whether by creditors committee or on the application of any individual creditor, the replacement office holders’ costs of complying with such request or order shall, unless good reasons to the contrary are demonstrated, be paid as costs of the winding up.
In the case of each bankruptcy and liquidation:
the creditors have the right to object and make representations to the Secretary of State in respect of the previous office holder’s release within 28 days of the date of this advertisement, and
the previous office holder will be entitled to apply to the Secretary of State for his release 21 days after the date of this advertisement.
