Strabane No. 1 Smoke Control Order 2006

1. Notice is hereby given that the Strabane District Council in exercise of powers conferred on them by Article 17 of the Clean Air (NI) Order 1981 on the 14th February 2006 made Orders entitled the Castlederg No.1 Smoke Control Order 2006, the Newtownstewart No.1 Smoke Control Order 2006 and the Strabane No. 1 Smoke Control Order 2006, declaring the areas described in the schedule hereto to be smoke control areas, which Orders are about to be submitted to the Department of the Environment for confirmation.
2. Subject to the exemptions provided by virtue of Articles 17 and 25 of the Clean Air (Northern Ireland) Order 1981, if, on any date after the Orders have come into operation, smoke is emitted from a chimney of any building within the smoke control areas the occupier of that building shall be guilty of an offence and liable to a fine not exceeding Level 3 on the Standard Scale (currently £1000) unless he proves that the emission of smoke was not caused by the use of any fuel other than an authorised fuel. The authorised fuels include, anthracite, coke and other carbonised fuels, gas and electricity.
3. Copies of the Smoke Control Orders and the maps referred to therein may be inspected free of charge at the Council Offices, 47 Derry Road, Strabane, during the period of six weeks from 9th March 2006.
4. Within the said period any person who will be affected by the Smoke Control Orders may by notice in writing to Air and Environmental Quality, Environment & Heritage Service, Commonwealth House, 35 Castle Street, Belfast BT1 1GU, object to the confirmation of the Orders.
SCHEDULE
Castlederg

The designated area incorporates the area beginning at Eden Park to the east, continuing west along Lower Strabane Road to Cavan Road, crossing Kilclean Road and north to Stoney Heights on Castlefin Road, south towards Hospital Road and Southeast to Strabane Road.

Newtownstewart

The designated area incorporates the area beginning at Deerpark to the west on Baronscourt Road to Castle Brae in the east, south towards Moyle Road, east to Oldcastle Road and north to Deerpark.

Strabane

The designated area incorporates the area beginning at Lifford Road roundabout, traveling south along the Great Northern Link to Brookvale, then east to the river Mourne to its junction with the Cavanalee River to Spout Road then north to Curlyhill Road, west to Glen Road, along Newtown Street and to Lifford Road via Abercorn Square and Railway Street.
