TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997

THE BURNSIDE, SKARES TREE PRESERVATION ORDER 2007

East Ayrshire Council, acting under the powers conferred on them by Sections 160 and 161 of the Town and Country Planning (Scotland) Act 1997, and of all other powers enabling them in that behalf and subject to the Forestry Act 1967 on 11 July 2007, made The Burnside, Skares Tree Preservation Order 2007 in respect of a tree at Burnside, Skares having been made because the mature beech tree situated adjacent to Ward Burn is an important feature at the eastern entrance to the hamlet of Skares attractively framing the views into and out of the settlement. It is therefore considered that the tree is worthy of being afforded the protection of a Tree Preservation Order.

This Order contains a direction under the Town and Country Planning (Scotland) Act 1997 the effect of which is that the said Order took effect on 11 July 2007, and shall continue in force until the expiration of a period of six months beginning with the date on which the Order was made or the date on which the Order is confirmed, whichever first occurs.

A Certified copy of the said Tree Preservation Order and relative map may be inspected at the Planning and Building Control Division, Croft Street, Kilmarnock between the hours of 9.00am and 5.00pm from Monday to Thursday and 9.00am to 4.00pm on Fridays.

You may make objections or representations with respect to the Order to the Planning Authority in accordance with regulation 7 of the Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas) (Scotland) Regulations 1975 as amended by the Town and Country Planning (Tree Preservation Order and Trees on Conservation Areas) (Scotland) Amendment Regulations, 1981.

REGULATION 7

(1) Every objection or representation to the Planning Authority with respect to an Order shall be made in writing, shall state the grounds thereof and specify the particular trees, groups of trees or woodlands in respect of which it is made.

(2) An objection or representation shall be duly made if it complies with paragraph (1) of this Regulation and is received by the planning Authority within 28 days from the date of the service of the notice of the making of the Order or the date of the publication of the notice by advertisement as the case may be.
