The Sutton (Waiting and Loading Restriction) (No. 1) Experimental Order 1998 The Sutton (On-Street Parking Places) (Zone A—Wellington Avenue) (No. 1) Experimental Order 1998
Notice is hereby given that on 19th January 1998, the Council of the London Borough
of Sutton made the above Orders under sections 9 and 10 of the Road Traffic Regulation
Act 1984, as amended by the Local Government Act 1985, the Road Traffic Regulation
(Parking) Act 1986, and the Road Traffic Act 1991.
The principal objective of these Orders is to prevent obstructive parking, improve
the environment and provide additional parking provision for local residents, the
use which will be controlled by parking permits. These Orders are being introduced
on an experimental basis in order that their provisions may be varied in the light
of operatonal experience.
The general effect of the Sutton (Waiting and Loading Restriction) (No. 1) Experimental
Order 1998 is to:
(a) amend an existing waiting restriction in Wellington Avenue, Worcester Park
to “at any time” from the south-western kerb-line of Cheam Common Road, south-westwards
for a distance of 15 metres; and
(b) introduce waiting restrictions in Wellington Avenue between 8 a.m. and 6.30
p.m. on Mondays to Saturdays inclusive, from a point 15 metres south-west of the south-western
kerb-line of Cheam Common Road to the south-western limit of Wellington Avenue.
The general effect of the Sutton (On-Street Parking Places) (Zone A—Wellington
Avenue) (No. 1) Experimental Order 1998, is to introduce a controlled parking zone
in Wellington Avenue, Worcester Park, by designating parking places to operate between
8 a.m. and 6.30 p.m. on Mondays to Saturdays inclusive at the following locations:
(a) the south-east side, between a point 15 metres south-west of the south-western
kerb-line of Cheam Common Road and a point 2.5 metres north-east of the south-western
flank wall of No. 31 Wellington Avenue, having a width throughout of 1.83 metres (located
partly on the footway maintaining a width of 1.2 metres for pedestrian use); and
(b) the north-west side, between a point 15 metres south-west of the south-western
kerb-line of Cheam Common Road and a point 2.5 metres north-east of the south-western
flank wall of No. 32 Wellington Avenue, having a width throughout of 1.83 metres (located
partly on the footway maintaining a width of 1.2 metres for pedestrian use).
Parking permits will be available for residents of Wellington Avenue and Nos. 33
and 35 Cheam Common Road, to purchase at a cost of £20 each per year. Each householder
in Wellington Avenue and Nos. 33 and 35 Cheam Common Road, will be able to apply for
residents’ visitor parking permits, which will allow their visitors to park during
the above hours without charge for up to 100 hours in a year. Further residents’ visitor
parking permits may be purchased from the Council at a cost of £15 per 100 hours of
parking time.
Full details of the Orders, which will come into operation on 2nd February 1998,
are contained in the following documents:
(a) the Orders;
(b) the Council’s statement of reasons for making the Orders; and
(c) a plan showing the location of the waiting restrictions and parking places.
These may be examined until the date on which the Order ceases to have effect at
Civic Offices, St. Nicholas Way, Sutton, 9 a.m. to 5 p.m., Monday to Friday, and Environmental
Services, 24 Denmark Road, Carshalton, 9 a.m. to 5 p.m., Monday to Friday.

The Orders provide that in pursuance of section 10(2) of the Road Traffic Regulation
Act 1984, the Head of Planning and Transportation of the London Borough of Sutton,
or other person authorised in that behalf by that officer may, if it appears to that
officer or to that person essential in the interests of the expeditious, convenient
and safe movement of traffic, or of the provision of suitable and adequate parking
facilities on the highway, or for preserving or improving the amenities of the area
through which the road affected by these Orders run, modify or suspend either or both
of these Orders or any provision thereof.
If the provisions of the Orders continue in operation for a period of not less
than 6 months, the London Borough of Sutton will consider in due course whether the
provisions of the Orders should be reproduced and continued in force indefinitely
by means of Orders under sections 6, 45 and 46 of the said Act of 1984. Persons desiring
to object to the making of the Orders under sections 6, 45 and 46 of the said Act
of 1984, for the purpose of such reproduction and continuation in force may, within
a period of 6 months, (ie by 3rd August 1998), send a statement in writing of their
objection and the grounds of that objection to the Director of Environmental Services,
Environmental Services, 24 Denmark Road, Carshalton, Surrey SM5 2JG, quoting Reference
PP98 in respect of the Sutton (On-Street Parking Places) (Zone A—Wellington Avenue)
(No. 1) Experimental Order 1998, and Reference WL99 in respect of the Sutton (Waiting
and Loading Restriction) (No. 1) Experimental Order 1998.
If any person wishes to question the validity of these Orders or of any of their
provisions on the grounds that it or they are not within the powers conferred by the
Road Traffic Regulation Act 1984, or that any requirement of the said Act of 1984
or of any Instrument made under the said Act of 1984, has not been complied with,
that person may, within 6 weeks from the date on which the Order is made, apply for
the purpose to the High Court.
