Southbury Road—Variation of Waiting and Loading Restrictions and Bus Stop Clearways and the Introduction of a Bus Lane

Notice is hereby given that the Council of the London Borough of Enfield on 16th February 1998, made:   (a) the Enfield (Bus Lane) (No. 1) Traffic Order 1998 under section 6 of the Road Traffic Regulation Act 1984, as amended by the Local Goverment Act 1985; and   (b) (i) the Enfield (Waiting and Loading Restriction) (Special Parking Area) (Amendment No. 103) Order 1998;       (ii) the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1, 1997) (Amendment No. 6) Traffic Order 1998,     under sections 6 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984, as amended by the Local Government Act 1985 and the Road Traffic Act 1991.   2. The general effect of Bus Lane Order will be to prohibit all vehicles from being in the area of carriageway (to be known as “the bus lane”) lying within or adjacent to the length of Southbury Road specified in Schedule 1 to this notice and between the north and north-eastern kerb-line of that road and a longitudinal white single line marked on the carriageway of that road, between 7 a.m. and 7 p.m. throughout the week.   3. The prohibition referred to in paragraph 2 above will not apply to:   (a) a bus; or   (b) a pedal cycle; or   (c) a licensed taxi;   (d) a Dial-a-Ride vehicle;   (e) a vehicle being used for ambulance, fire brigade or police purposes if it is reasonably necessary for that vehicle to be in the bus lane; or   (f) any vehicle being used in connection with the removal of any obstruction in the bus lane;   (g) any vehicle being used for purposes in connection with the statutory powers or duties of a local authority or the supply of gas, water or electricity, or in connection with any building operation, demolition or excavation in or adjacent to the bus lane, provided that in all the circumstances it is reasonably necessary for the vehicle to be in the bus lane; or   (h) any vehicle which bears the Royal Mail livery:       (i) while postal packets addressed to premises adjacent to the bus lane are being unloaded from that vehicle or, having been unloaded therefrom, are being delivered; or       (ii) while postal packets are being collected for loading on the vehicle from premises or posting boxes adjacent to the bus lane or, having been so collected, are being loaded thereon;   (i) any vehicle in the bus lane for the sole purpose of waiting for as long as may be necessary to enable a person suffering from any disability or injury (including blindness) which seriously impairs his ability to walk to board or alight from that vehicle; or   (j) any vehicle in the bus lane:       (i) from any vehicular accessway or crossing over the footway adjoining the bus lane if that vehicle forthwith leaves the bus lane at a point opposite that vehicular accessway or crossing;       (ii) from any part of Southbury Road which does not comprise the bus lane at a point opposite any vehicular accessway or crossing over the footway adjoining the bus lane if that vehicle forthwith enters that vehicular accessway or crossing;   (k) any vehicle if the driver thereof is obliged to be in the bus lane in order to avoid an accident and forthwith causes that vehicle to leave the bus lane; or   (l) any vehicle if the driver thereof is required by law to stop and as soon as reasonably practicable; thereafter causes that vehicle to leave the bus lane; or   (m) anything done:       (i) with the permission or at the direction of a police constable in uniform or a traffic warden;       (ii) in accordance with any prohibition, restriction or requirement indicated by traffic signs placed on the highway by or on behalf of the Metropolitan Police.   4. The general effect of the Waiting and Loading Restriction Order will be further to amend the Enfield (Waiting and Loading Restriction) (Special Parking Area) Order 1994, so that:   (a) the hours during which the existing prohibition applies on waiting by vehicles (otherwise than for the purpose of delivering or collecting goods or loading or unloading a vehicle) will be changed so that it will apply at time throughout the week in the lengths of street specified in Schedule 2 to this notice;   (b) the hours during which the exisiting prohibition applies on waiting by vehicles for the purpose of delivering or collecting goods or loading or unloading a vehicle for a period of more than 20 minutes in the same place will be changed so that it will apply at any time throughout the week in the lengths of street referred to in sub-paragraph (a) above.   5. The prohibitions referred to in paragraph 4(a) and (b) above will not apply in respect of anything done with the permission or at the direction of a police constable in uniform, a traffic warden or a parking attendant or in certain circumstances, e.g., the picking up or setting down of passengers; the carrying out of statutory powers or duties; the taking in of petrol, etc., from roadside petrol stations; to licensed street traders, etc.   6. The general effect of the Restriction of Waiting on Bus Stops Order will be:   (a) vehicles will be prohibited from stopping at any time throughout the week on the areas of carriageway of the street specified in Schedule 3 to this notice and which areas will be marked on the carriageway by yellow “bus stop” markings and by a solid yellow line within those markings;   (b) any existing restrictions on waiting by vehicles, on the sale of goods and on advertising activities imposed by the Enfield (Restriction on Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1994, in the lengths of street specified in Schedule 4 to this notice will be revoked.   7. The prohibitions referred to in paragraph 6 above will not apply:   (a) to a bus, whilst picking up or setting down passengers; or   (b) to a taxi, whilst picking up or setting down passengers; or   (c) to a vehicle being used for ambulance, fire brigade or police purposes; or   (d) in certain circumstances, to a vehicle being used in the service of a local authority, to a vehicle being used in connection with building operations, etc., adjacent to the bus stop or the removal of any obstruction to traffic or the repair, etc., of the highway or of any service therein; or   (e) where the person in control of the vehicle is required by law to stop, or does so in order to avoid an accident; or   (f) to anything done with the permission of a police constable in uniform, a traffic warden or a parking attendant.   8. A copy of each of the Orders, which will come into operation on 2nd March 1998, of maps indicating the location and effect of the Orders, of the Council’s statement of reasons for proposing to make the Orders and of the Enfield (Waiting and Loading Restriction) (Special Parking Area) Order 1994, the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1994 and the Enfield (Restriction of Waiting on Bus Stops) (Special Parking Area) (No. 1) Traffic Order 1997 (and of the Orders which have previously amended those Orders) can be inspected at the Reception Desk, “B” Block, the Civic Centre, Silver Street, Enfield, Middlesex EN1 3XD, during normal office hours on Mondays to Fridays inclusive until the end of 6 weeks from the date on which the Orders were made.   9. Copies of the Orders may be obtained from the Traffic Engineering Group, the Civic Centre, Silver Street, Enfield, Middlesex EN1 3XD.   10. Any person desiring to question the validity of any of the Orders or of any provision contained therein on the grounds that it is not within the relevant powers of the Road Traffic Regulation Act 1984, or that any of the relevant requirements thereof or of any relevant regulations made thereunder has not been complied with in relation to any of the Orders may, within 6 weeks of the date on which the Order was made, make application for the purposes to the High Court. Bus Lane—7 a.m. to 7 p.m. throughout the week

Southbury Road, between a point 26 metres west of a point opposite the western wall of Tricity House, Southbury Road and a point 2 metres east of the common boundary of Tricity House, Southbury Road and Lombard House, Southbury Road.

Schedule 2
Waiting and Loading—change existing restrictions to at any time throughout the week

Southbury Road   (a) the north side, between the western kerb-line of Baird Road and a point opposite the eastern wall of No. 280 Southbury Road;   (b) the south side, between the western kerb-line of the access road lying immediately west of No. 339 Southbury Road leading to Nos. 327 and 333 to 337 a (odd) Southbury Road and a point 4 metres east of a point opposite the eastern wall of No. 280 Southbury Road.

Schedule 3
Bus Stop Clearways—At Any Time throughout the week

Southbury Road   (a) the north side, from a point 57 metres west of the western kerb-line of Baird Road westward for a distance of 25 metres.   (b) the south side, from a point 41 metres west of the western kerb-line of Baird Road westward for a distance of 19 metres.

Schedule 4
Bus Stop Clearways to be revoked

Southbury Road   (a) the north side, from a point 57 metres west of the western kerb-line of Baird Road westward for a distance of 47 metres.   (b) the south side, from a point 44 metres west of the western kerb-line of Baird Road westward for a distance of 19 metres. 16th February 1998.
