TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Tyne and Wear) (No. 11) Order 1998” authorising the stopping-up of areas of highway at Roker Avenue, George Street North and Causeway, Monkwearmouth, Sunderland, Tyne and Wear to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to David Kitchen Associates, acting on behalf of W M Pensions Fund, London York Fund Managers Limited, by The Council of the City of Sunderland, on 2nd September 1997 under Ref. 97/00517/FUL.   Copies of the Order may be obtained, free of charge, on application to the Secretary of State at the offices of the Director Planning, Environment and Transport, Government Office for the North East, Wellbar House, Gallowgate, Newcastle upon Tyne NE1 4TD (quoting Ref. GO-NE/98/5038/35/1) and may be inspected at all reasonable hours at the offices of the Council of the City of Sunderland, Reception Desk, Administration Department, Civic Centre, Burdon Road, Sunderland SR2 7DN.   Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 14th July 1998 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein. Schedule

  The planning permission granted is for the erection of carpet and furniture retail warehouse and associated car parking including change of use from public highway to car parking, retailing and landscaped areas.
