The Stopping-up of Highways (Tresillian Way, Butetown, Cardiff) Order 1998

The Secretary of State for Wales hereby gives notice that he has made an Order under section 248 of the Town and Country Planning Act 1990 to authorise the stopping-up of the section of highway described in the Schedule to this notice.   The stopping-up is authorised only in order to facilitate the movement of traffic on, and in the interests of the safety of users of, the main highway which is to be constructed in accordance with planning permission granted by the County Council of the city and county of Cardiff on 12th January 1998 under Ref. 94/01987/R. The Order shall cease to have effect upon the cessation of the planning permission.   The Order will require the provision of new highway which will be highway maintainable at public expense, for which the County Council of the city and county of Cardiff shall be the Highway Authority.   Copies of the Order and the deposited plan may be inspected, free of charge, during normal office hours at the offices of Cardiff County Council, County Hall, Atlantic Wharf, Cardiff, or may be obtained, free of charge, from the Welsh Office, Highways Directorate, Cathays Park, Cardiff CF1 3NQ (quoting reference ZC510-5-71-17).   If any person desires to question the validity of the Order, or of any of the provisions contained therein, on the grounds:   (a) that it is not within the powers of the Town and Country Planning Act 1990; or   (b) that their interests have been substantially prejudiced by a failure to comply with any of the requirements of the Act, he may, within 6 weeks of 2nd October 1998 apply to the High Court for the suspension or quashing of the Order or of any provision contained therein. Description of the section of highway to be stopped up under this Order   The highway to be stopped up is at Butetown in Cardiff. It is shown by zebra hatching on the deposited plan and comprises a section of highway, including carriageway and footway, known in part as Tresillian Way, in part as West Wharf Road, in part as West Canal Wharf and in part as East Canal Wharf which extends from its southernmost junction with Tresillian Terrace in a general easterly direction for a distance of 250 metres, to a point 62 metres south-west of its junction with Bute Street and has a maximum width of 27 metres and a total area of 4,121 square metres. Description of the new highway to be provided under this Order   The highways to be provided are at Butetown in Cardiff and comprise:   (i) To replace the present Tresillian Way route, a new dual carriageway will be provided from the Penarth Road/Tresillian Terrace junction generally eastwards to a new roundabout at location of existing roads, West Canal Wharf and East Canal Wharf. From this new roundabout, the new road will continue as split eastbound and westbound carriageways (parallel with Crichton Street and Wharf Street respectively) to Bute Street.   (ii) A new section of highway will run north-westwards from the new roundabout to form a revised and improved junction with Custom House Street, St. Mary Street, Saunders Road and Mill Lane at their present junction. A short length of new road will link Penarth Road to West Wharf Road to maintain local vehicular access to West Wharf Road and West Canal Wharf.   In addition cycle tracks and cycle lanes will be provided within the new improved road infrastructure to cater, in particular, for cyclists’ north-south movements. Consultation on their exact locations are continuing.
