The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he proposes to make an Order under section 247 of the above Act, which will authorise the stopping-up of lengths of highway at Chalons Way/Rutland Street, Ilkeston, Derbyshire, as detailed below: (1) A length on Chalons Way at a point 50 metres south-east of the junction with Rutland Street measuring 36 metres in length; and (2) A length of footpath leading from Rutland Street, from a point 97 metres from the junction with Chalons Way, in a southerly direction for 122 metres. If the Order is made, the stopping-up will be authorised only in order to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted to Miller Developments by Erewash Borough Council on 24 April 2001 under Ref ERE/0100/0039). The proposed Order will require the provision of a new footpath and the improvement of existing highway by Tesco Stores Ltd, maintainable at public expense, and for which the highway authority is to be the Derbyshire County Council. Copies of the draft Order and relevant plan may be inspected at all reasonable hours during the 28 days commencing on 3 August 2001 at the Erewash Borough Council, Town Hall, Ilkeston, Derbyshire, and may be obtained, free of charge, from the Government Office for the East Midlands (quoting Ref EMCM 505035/1/228) at the address below. Any person may object to the making of the proposed Order within the period of 28 days commencing on 3 August 2001 by notice to the Secretary of State for the Environment, Transport and the Regions quoting the above reference, at the Government Office for the East Midlands, Transport, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham NG1 5GG.
