NOTICE OF PROPOSED AMENDMENTS TO AN APPLICATION FOR AN ORDER

The Tyne and Wear Passenger Transport Authority of the Civic Centre, Newcastle upon Tyne NE1 8PD (the “applicant”) applied to the Secretary of State for Transport, Local Government and the Regions under section 6 of the Transport and Works Act 1992, for the above-mentioned Order (the “draft Order”) under section 3 of that Act on 31 May 2002. A public inquiry was held into the application for the Order between March and May 2003. The applicant now proposes amendments to the draft Order. The proposed amendments to the draft Order make provision: 1. to remove areas of land from the powers of compulsory acquisition under the draft Order that have been identified by the local planning authority and/or the applicant as open space, or possible open space; and 2. to provide consistent provisions for the payment of compensation to persons having interests in or over land, including open space, whether acquired by compulsory acquisition, agreement or appropriation for the purposes of the draft Order. A copy of the proposed amendments to the draft Order with related documents, the original application, and of all plans and other documents submitted with the application, may be inspected, free of charge, at the following locations and times until 17 November 2004: (a) The Civic Centre, Newcastle upon Tyne NE1 8PD; between the hours of 10.00 am and 4.00 pm, Monday to Friday. (b) Jarrow Library, Cambrian Street, South Tyneside: Monday 9.30 am to 12.30 pm; 1.30 pm to 7.00 pm; Tuesday 9.30 am to 12.30 pm; 1.30 pm to 5.00 pm; Wednesday 9.30 am to 1.00 pm; Thursday 9.30 am to 12.30 pm; 1.30 pm to 7.00 pm; Friday 9.30 am to 12.30 pm; 1.30 pm to 5.00 pm; Saturday 9.00 am to 1.00 pm. (c) Howdon Library, Churchill Street, North Tyneside: Monday 9.00 am to 1.00 pm; Tuesday 9.00 am to 1.00 pm; 2.00 pm to 7.00 pm; Thursday 9.00 am to 1.00 pm; Friday 9.00 am to 1.00 pm; Saturday 9.00 am to 1.00 pm; 2.00 pm to 5.00 pm. Any representations about the proposed amendments to the application referred to above should be sent to the Secretary of State for Transport, c/o the TWA Orders Unit, Zone 9/02, Department for Transport, Southside, 105 Victoria Street, London SW1E 6DT, on or before 17 November 2004. A representation must (i) be received by the Secretary of State on or before 17 November 2004, (ii) be made in writing, (iii) state the grounds of the representation and (iv) indicate who is making the representation, and (v) give an address to which correspondence relating to the representation may be sent.
