THE TRANSPORT AND WORKS (APPLICATIONS AND OBJECTIONS PROCEDURE) (ENGLAND AND WALES) RULES 2006

PROPOSED ECCLESBOURNE VALLEY RAILWAY ORDER

WyvernRail plc (“WyvernRail”) of Wirksworth Station, Coldwell Street, Wirksworth, Matlock, Derbyshire, DE4 4FB is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992, for the above-mentioned Order under sections 1 and 5 of that Act.

The draft Order would provide for the transfer from Network Rail Infrastructure Limited to WyvernRail of the statutory rights, powers, privileges and obligations relating to the existing branch railway (“the railway”) located between Duffield and Wirksworth in the county of Derbyshire, with effect from the date when the railway is sold to WyvernRail. The draft Order would also provide for the transfer from Lafarge Tarmac Cement & Lime Limited to WyvernRail of the existing former Tarmac Roadstone private siding (“the siding”) that joins the railway at Wirksworth and currently forms WyvernRail’s Ravenstor station, with effect from the date upon which the siding is sold or leased to WyvernRail. The Order would also provide for powers to WyvernRail to operate and use the railway and siding and for the transfer of that undertaking with the consent of the Secretary of State for Transport.

This application is not to be made subject to an environmental impact assessment.

An objection or representation MUST (i) be received by the Secretary of State on or before 31 March 2015, (ii) be made in writing (whether sent by post or email), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or representation, and (v) give an address to which correspondence relating to the objection or representation may be sent. (If you are sending your objection or other representation by e-mail, please provide a postal address and state “Ecclesbourne Valley Railway Order” in the subject of the email.)

The Secretary of State may make complete copies of the objections and other representations public, including any personal information in them, and will copy them to the applicant for the Order.
