1. Mae Gweinidogion Cymru—

(a) ar ôl gwneud datganiad o dan baragraff 26(1) o Atodlen 22 i Ddeddf y Coronafeirws 2020 ar 29 Mawrth 2020, a

(b) ar ôl rhoi sylw i gyngor a gafwyd gan Brif Swyddog Meddygol Cymru,

yn dyroddi’r cyfarwyddyd hwn o dan baragraff 29(1) o Atodlen 22 i Ddeddf y Coronafeirws 2020 at ddibenion atal, diogelu rhag, a rheoli mynychder neu drosglwyddiad y coronafeirws.

2. Yn y cyfarwyddyd hwn, ystyr “mangre benodedig” yw mangre Cinema&Co. Swansea Ltd yn 17 Castle Street, Abertawe, SA1 1JF.

3. Rhaid i’r fangre benodedig fod wedi ei chau am 3.45 p.m. ar 26 Tachwedd 2021 a pharhau i fod ar gau—

(a) hyd nes y penderfynir ynghylch cais a wnaed gan Gyngor Dinas a Sir Abertawe ar 23 Tachwedd 2021 mewn cysylltiad â’r fangre benodedig am Orchymyn o dan adran 45I o Ddeddf Iechyd y Cyhoedd (Rheoli Clefydau) 1984, gan gynnwys unrhyw apêl a wneir o dan adran 67 o’r Ddeddf honno, neu

(b) os yn gynharach—

(i) hyd nes y caiff y datganiad y cyfeirir ato ym mharagraff 1(a) ei ddirymu gan Weinidogion Cymru, neu

(ii) hyd nes y caiff y cyfarwyddyd hwn ei ddirymu gan Weinidogion Cymru.

4. Rhaid i’r personau a ganlyn gymryd unrhyw gamau gweithredu sy’n angenrheidiol i sicrhau bod y fangre benodedig yn cau ac yn parhau i fod ar gau yn unol â pharagraff 3—

(a) perchennog neu feddiannydd y fangre benodedig;

(b) unrhyw berson arall sy’n ymwneud â rheoli mynediad i’r fangre honno neu ymadawiad â’r fangre honno.

5. Yn ystod y cyfnod a ddisgrifir ym mharagraff 3, ni chaiff unrhyw berson fynd i’r fangre benodedig, neu fod yn y fangre benodedig, oni bai ei fod wedi ei awdurdodi (ar lafar neu yn ysgrifenedig) gan—

(a) Gweinidogion Cymru,

(b) Cyngor Dinas a Sir Abertawe,

(c) Ymddiriedolaeth Gwasanaeth Iechyd Gwladol Iechyd Cyhoeddus Cymru, neu

(d) cwnstabl.

PUBLIC HEALTH, WALES

DIRECTION UNDER PARAGRAPH 29 OF SCHEDULE 22 TO THE CORONAVIRUS ACT 2020 – PREMISES OF CINEMA&CO. SWANSEA LTD

Issued at 3.10 p.m. on 26 November 2021

1. The Welsh Ministers—

(a) having made a declaration under paragraph 26(1) of Schedule 22 to the Coronavirus Act 2020 on 29 March 2020, and

(b) having had regard to advice received from the Chief Medical Officer for Wales,

issue this direction under paragraph 29(1) of Schedule 22 to the Coronavirus Act 2020 for the purposes of preventing, protecting against and controlling the incidence or transmission of coronavirus.

2. In this direction, the “specified premises” means the premises of Cinema&Co. Swansea Ltd at 17 Castle Street, Swansea, SA1 1JF.

3. The specified premises must be closed at 3.45 p.m. on 26 November 2021 and remain closed until—

(a) the determination of an application made by Swansea City and County Council on 23 November 2021 in respect of the specified premises for an Order under section 45I of the Public Health (Control of Disease) Act 1984, including any appeal made under section 67 of that Act, or

(b) if earlier—

(i) the declaration referred to in paragraph 1(a) is revoked by the Welsh Ministers, or

(ii) this direction is revoked by the Welsh Ministers.

4. The following persons must take such action as is necessary to ensure that the specified premises are closed and remain closed in accordance with paragraph 3—

(a) the owner or occupier of the specified premises;

(b) any other person involved in managing entry into, or departure from, those premises.

5. During the period described in paragraph 3, no person may enter, or be on, the specified premises unless authorised (verbally or in writing) by—

(a) the Welsh Ministers,

(b) Swansea City and County Council,

(c) the Public Health Wales National Health Service Trust, or

(d) a constable.
