The Network Rail (Church Fenton Level Crossing Reduction) Order

NOTICE OF APPLICATION FOR AN ORDER

Network Rail Infrastructure Limited (“Network Rail”) of 1 Eversholt Street, London, NW1 2DN, is applying to the Secretary of State for Transport under section 6 of the Transport and Works Act 1992, for the above-mentioned order under section 1 and 5 of that Act.

The purpose of the Order is to provide Network Rail with powers to authorise works and purchase of land to replace a footbridge and mitigate the closure of three private rights vehicular access level crossings, known as Rose Lane, Poulters and Adamsons, located within an approximately 1km length of line commencing 300 metres south-west of Church Fenton station in the District of Selby. It also authorises the acquisition of land for the provision of railway infrastructure for which Network Rail has permitted development rights.

The Order would authorise the closure of the three level crossings and provide new pedestrian and vehicular access routes for private rights holders across the railway. This will be achieved by replacing the vehicle level crossing access with a new road bridge which will join Common Lane to the southern end of Rose Lane. The existing footbridge over the railway line located on Rose Lane will be removed and a new footbridge will be provided in the location.

The Order includes provisions for –

* the compulsory acquisition of land for the proposed works and ancillary purposes, including worksites; the acquisition of rights over specified land; provisions for the temporary use of land in connection with the proposed scheme; and the extinction and creation of private rights; and

* the temporary stopping up of highways; closure of level crossings; provisions relating to streets; and powers to survey and investigate land.

The Secretary of State has determined that the application is not to be made subject to an environmental impact assessment.

The application contains a statement that a direction for deemed planning permission is being applied for.

A copy of the TWA application and of all plans and other documents submitted with them, may be inspected free of charge from 28 July to 8 September 2022 at Sherburn and Villages Community Library, Finkle Hill, Sherburn-in-Elmet LS25 6EA at the following times;

* Mondays, Tuesdays and Thursdays: 9.30am to 5pm

* Fridays: 9.30am to 1pm

* Saturdays: 9.30am to 12.30pm

* Wednesdays and Sundays: closed.

An objection or representation MUST (i) be received by the Secretary of State on or before 8 September 2022, (ii) be made in writing (whether sent by post or email), (iii) state the grounds of the objection or other representation, (iv) indicate who is making the objection or other representation, and (v) give an address to which correspondence relating to the objection or other representation may be sent. (If you are sending your objection or other representation by e-mail, please provide a postal address and state "Network Rail (Church Fenton Level Crossing Reduction) Order" in the subject of the email.

The Secretary of State may make complete copies of the objections and other representations public, including any personal information in them, and will copy them to the applicant for the Order.
