1. Notice is hereby given that Gedling Borough Council ("the Council") of Civic Centre, Arnot Hill Park, Arnold, Nottinghamshire, NG5 6LU proposes to make an Order, in the exercise of its powers under Section 18 of the Clean Air Act 1993 ("the Act") declare its area to be a Smoke Control Area.

2. The proposed Order entitled “the Gedling Borough Council Smoke Control Order 2024” would come into operation by or before summer/autumn 2024.

3. The area covered by the proposed Order is the whole of the Borough of Gedling.

4. If, on any day after the proposed Order comes into operation, smoke is emitted from a chimney of any building within the area covered by the Order, the occupier of that building will be liable to a financial penalty of between £175 and £300.

5. If, on any day after the proposed Order comes into operation, any person acquires for use in a fireplace other than an exempted fireplace, or sells by retail for delivery, unauthorised fuel within the area covered by the Order, he will be guilty of an offence and liable to a fine, unless, in the case of an offence consisting of the sale of unauthorised fuel for delivery, he proves he believed and had reasonable grounds for believing that the fuel was acquired for use in an exempted fireplace. The authorised fuels and exempted fireplaces for the purposes of Section 19B of the Act are those published in lists by the Secretary of State and updated from time to time on the Defra website on gov.uk.

6. Copies of the proposed Order and accompanying plan may be inspected free of charge during normal office hours from 20th November 2023 to 5th January 2024 at Civic Centre, Arnot Hill Park, Arnold, Nottinghamshire, NG5 6LU

7. Within this period, any person who will be affected by the proposed Order may object by writing to Public Protection, Gedling Borough Council, Civic Centre, Arnot Hill Park, Arnold, Nottinghamshire, NG5 6LU
