IN THE MATTER OF SECTIONS 7(5), 108, 168(3), 168(5), 263(5), PARAGRAPH 39(6) OF SCHEDULE A1, AND PARAGRAPH 88 OF SCHEDULE B1 OF THE INSOLVENCY ACT 1986 AND RULE 12.36(2) OF THE INSOLVENCY RULES 2016

BETWEEN: ANDREW DAVID ROSLER (Applicant) and TOM BOWES (Respondent)

Notice is hereby given that pursuant to a block transfer order of insolvency cases of District Judge Richmond dated 17th November 2023 it has been ordered that:

1. The Respondent be removed from office as Joint Liquidator of the companies in Creditors Voluntary Liquidation listed in Schedule 1 attached hereto pursuant to section 108 of the Insolvency Act 1986, with effect from 30 November 2023 and the Applicant continue to act as sole Liquidator in substitution in respect of the said companies, with effect from the same date, pursuant to section 108 of the Insolvency Act 1986.

2. The Respondent be removed from office as Joint Liquidator of the companies in Members Voluntary Liquidation listed in Schedule 2 attached hereto pursuant to section 108 of the Insolvency Act 1986, with effect from 30 November 2023 and the Applicant continue to act as sole Liquidator in substitution in respect of the said companies, with effect from the same date, pursuant to section 108 of the Insolvency Act 1986.

3. The Respondent be removed from office as Joint Liquidator of the company in Compulsory Liquidation listed in Schedule 3 attached hereto pursuant to sections 168(3) and 168(5) of the Insolvency Act 1986 and Rule 12.36(2) of the Insolvency Rules 2016, with effect from 30 November 2023 and the Applicant continue to act as sole Liquidator in substitution in respect of the said company, with effect from the same date, pursuant to sections 168(3) and 168(5) of the Insolvency Act 1986 and Rule 12.36(2)(a) of the Insolvency Rules 2016.

4. The Respondent be removed from office as Supervisor of the Company Voluntary Arrangements of the companies listed in Schedule 4 attached hereto pursuant to section 7(5) of the Insolvency Act 1986, with effect from 30 November 2023, and the Applicant be appointed as Supervisor in substitution in respect of the said Company Voluntary Arrangements, with effect from the same date, pursuant to section 7(5) of the Insolvency Act 1986.

5. The Respondent be removed from office as Supervisor of the Individual Voluntary Arrangements of the individuals listed in Schedule 5 hereto pursuant to section 263(5) of the Insolvency Act 1986, with effect from 30 November 2023 and the Applicant be appointed as Supervisor in substitution in respect of the said Individual Voluntary Arrangements, with effect from the same date, pursuant to section 263(5) of the Insolvency Act 1986.

6. The Respondent be removed from office as Joint Administrator of the companies in Administration listed in Schedule 6 attached hereto pursuant to paragraph 88 of Schedule B1 of the Insolvency Act 1986, with effect from 30 November 2023 and the Applicant continue to act as sole Administrator in substitution in respect of the said companies, with effect from the same date.

7. The Creditors Voluntary Liquidations, Members Voluntary Liquidations, Compulsory Liquidation, Company Voluntary Arrangements, Individual Voluntary Arrangements and Administrations listed in Schedules 1 to 6 attached hereto which are (or were) proceeding in a County Court be transferred to the High Court for the purpose of this Order only.

8. Where required any relevant notice required to be filed at Court be filed at the same time as the next notification as required pursuant to statute.

9. The appointments made pursuant to the application hearing be notified to the creditors at the same time as the next report pursuant to statute is made to the creditors.

10. The Respondent shall give written notice of the making of this Order by block advertisement in the London Gazette, such notice to include the following matters:

a. an explanation as to the effect of the Order; and

b. express reference to the liberty to apply as set out in the Order.

11. Liberty to every creditor of each Creditors Voluntary Liquidation, Members Voluntary Liquidation, Compulsory Liquidation, Company Voluntary Arrangement, Individual Voluntary Arrangement and Administration to apply to vary or discharge this Order within 28 days of this notice appearing in the London Gazette.

The effect of the above-mentioned Order is that Mr Bowes no longer holds office in relation to any of the cases detailed in the below schedules, and Mr Rosler proceeds as sole office holder in relation to all such cases.
