BLOCK TRANSFER OF INSOLVENCY CASES

IN THE HIGH COURT OF JUSTICE

BUSINESS AND PROPERTY COURTS AT NEWCASTLE UPON TYNE

PURSUANT TO A BLOCK TRANSFER ORDER on 11 January 2025 IT WAS ORDERD AS FOLLOWS:

1. Each of the Court cases listed in Schedule 1 (below) be transferred to the High Court of Justice, Business and Property Courts in Newcastle upon Tyne for the purpose only of making this order only.

2. Immediately upon the order taking effect, the Court cases listed in Schedule 1 be transferred back to the original Court.

3. James Campbell Gibson (outgoing office-holder) be removed from office in respect of each of the cases listed in Parts 1 and 2 of Schedule 1 (attached to this order) (block transfer cases) from the date of this order.

4. The First Respondent be appointed as replacement office-holder in respect of each of the block transfer cases listed in Part 1 of Schedule 1 and the Second Respondent be appointed as replacement office-holder (the First and Second Respondents together the ?Replacement office-holders?) in respect of each of the block transfer cares listed in Part 2 of Schedule 1 from the date of this order.

5. The creditors in each of the block transfer cases shall be notified of this order by way of one composite notice placed by the Replacement office-holders to be published in the London Gazette within 28 days of the date of this order.

6. There shall be liberty to each creditor to apply to vary or discharge this Order within 21 days of being given notice in accordance with paragraph 5 of this Order insofar as it relates to the liquidation or estate of which they are a creditor. Such application (if any) shall not affect the transfer of the block transfer cases until further or other order by the Court.

7. The replacement office-holders shall serve and file a copy of this Order in each of the Courts listed in Schedule 1, on the Secretary of State and the Register of Companies (in respect of any corporate insolvency cases listed).

8. The removal and appointments by this Order shall not affect the respective reporting periods or obligations in the block transfer cases.

9. The outgoing office-holder shall receive his release as liquidator or trustee 21 days after filing notice of removal with the Registrar of Companies in respect of any corporate insolvencies and in any other case on the giving of notice to creditors in accordance with this order. Save that such release may be subject to further order in the event of an application by a creditor under paragraph 6 of this order for the specific case subject to that application.

10. No order as to costs
