TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997 - THE HIGHLAND COUNCIL (NESS WALK – BISHOPS ROAD, INVERNESS) (FOOTWAY) (STOPPING UP) ORDER 2014
NOTICE IS HEREBY GIVEN THAT on 6 January 2014 The Highland Council made an order under Section 207 of the Town and Country Planning (Scotland) Act 1997 (“the 1997 Act”) stopping up of the length of road (now comprising part of the footway) at Ness Walk Pedestrian Area described in the Schedule below being satisfied that it has become necessary to authorise the stopping up in order to enable development to be carried out in accordance with planning permission granted under Part III of the said the 1997 Act. The Order is about to be submitted to the Scottish Ministers for confirmation or to be confirmed as an unopposed Order.
The title of the Order is “The Highland Council (Ness Walk – Bishops Road, Inverness) (Footway) (Stopping Up) Order 2014”. A copy of the Order and of the relevant plan showing the length of road (now comprising part of the footway) to be stopped up have been deposited at The Highland Council Service Point, 23 Church Street, Inverness. Those documents are available for inspection free of charge for a period of twenty eight days from 14 January 2014 during the hours of 9.30am and 4.30pm Mondays to Fridays inclusive.
Any person may, within 28 days from 14 January 2014 make representations or object to the making of the Order prior to its confirmation by notice in writing to the Head of Legal & Democratic Services, The Highland Council, Council Buildings, Glenurquhart Road Inverness IV3 5NX, quoting reference L/PLIN237:KL. Representations and objections should state the name and address of the person by whom they are made, the matters to which they relate and the grounds on which they are made.

SCHEDULE - AREA/LENGTH OF ROAD (NOW COMPRISING PART OF THE FOOTWAY) TO BE STOPPED UP
The commencement point for the area/length of road to be stopped up is referred to as Point A. Point A is located by extending the southern boundary of the Cathedral Car Park to the eastern kerb line of Bishops Road, then northeast along this kerb line for a distance of 12.225 metres, then southeast of this kerb line, at right angles to the kerb line, for a distance of 0.665 metres. The area/length of road to be stopped up is from Point A south-eastwards for a distance of 3.345 metres or thereby, north-eastwards for a distance of 7.520 metres or thereby, north-westwards for a distance of 3.345 metres or thereby, south-westwards for a distance of 7.520 metres or thereby back to the commencement point, Point A. The footprint of the area/length of road to be stopped up is 25.15m2.
