Notice is hereby given that on 9th January 2003 an Administration Petition was presented to the Court of Session, Edinburgh by The Governor and Company of the Bank of Scotland, a company incorporated by Act of Parliament with its Principal Office at The Mound, Edinburgh EH1 1YZ and Australia and New Zealand Banking Group Limited, a Company incorporated in Australia with its Registered Office at Level 6, 100 Queen Street, Melbourne, Victoria, Australia, in respect of Fife Power (“the Company”) an unlimited Company incorporated under the Companies Acts (Company Number SC162872) and having its Registered Office at Westfield Development Centre, Cardenden, Fife, KY5 0HP, in which Petition the Court inter alia granted the following interim orders:
(1) | appointed in terms of Section 9(4) of the Insolvency Act 1986 (“the 1986 Act”) Thomas Merchant Burton and Colin Peter Dempster both of Ernst & Young, George House, 50 George Square, Glasgow (“the Interim Managers”) jointly to manage the affairs of the Company for the purpose specified in Section 8(3)(d) of the 1986 Act and authorising them (or either of them) to exercise in respect of the Company any of the powers set out in Section 14 and Schedule 1 of the 1986 Act, in each case until the determination of the application; |
(2) | ad interim suspended, in terms of Sections 9(4) and 9(5) of the 1986 Act, the exercise without the consent of the Court or the Interim Managers, by the directors of Fife Power of any of their powers under its Memorandum and Articles of Association or the Companies Act 1985, until the determination of the application; |
and allows any party claiming an interest to lodge Answers thereto if so advised within eight days after such intimation and service, of all of which notice is hereby given.
