Note: The amendment to the Scheme which follows this note has been made under section 89 of the Postal Services Act 2000 and amends the Successor Postal Services Company Overseas Letter Post Scheme 2001. This amendment to the Scheme, which comes into force on 1st April 2004 revises certain postage rates, amends the postage rate structure relating to mail sent to members of HM Forces, introduces Airsure packs for European destinations and amends the level of compensation for ordinary postal packets.

ROYAL MAIL GROUP PLC OVERSEAS LETTER POST (AMENDMENT No. 9) SCHEME 2004

Made 26th March 2004

Coming into operation 1st April 2004

Royal Mail Group plc(a) by virtue of the powers conferred upon it by section 89 of the Postal Services Act 2000 and all other powers enabling it in this behalf, hereby makes the following amendment to the Scheme:

Commencement, citation and inter pretation

1.	(1)	This amendment to the Scheme shall come into force on 1st April 2004 and may be cited as the Royal Mail Group plc Company Overseas Letter Post Amendment (No.9) Scheme 2004.
(2)	This amendment to the Scheme shall be read as one with the Successor Postal Services Company Overseas Letter Post Scheme 2001(b) (hereinafter called “the Scheme”), as amended by the Consignia plc Overseas Letter Post Amendment (No.1) Scheme 2001(c), the Consignia plc Overseas Letter Post Amendment (No.2) Scheme 2001(d), the Consignia plc Overseas Letter Post Amendment (No.3) Scheme 2001(e), the Consignia plc Overseas Letter Post Amendment (No.4) Scheme 2002(f), the Consignia plc Overseas Letter Post Amendment (No.5) Scheme 2002(g), the Royal Mail Group plc Overseas Letter Post Amendment (No.6) Scheme 2003 (h)., the Royal Mail Group plc Overseas Letter Post Amendment (No.7) Scheme 2003(i) and the Royal Mail Group plc Overseas Letter Post Amendment (No.8) Scheme 2004(j)
2.	A reference in the Scheme to the Successor Postal Services Company shall be read as a reference to Royal Mail Group plc.

Letters and postcards other than airmail packets

3.	(1)	In sub-paragraph (1) of paragraph 5 of the Scheme, the phrase “Part 2A” shall be deleted and substituted by “Part 1”.
(2)	In sub-paragraph (2) of paragraph 5 of the Scheme, the phrase “Part 2B” shall be deleted and substituted by “Part 2”.
(3)	In paragraph 5 of the Scheme, the following new sub-paragraph (3) shall be inserted:
“(3) postage at the rates specified in Part 3 of Schedule 1 to the Scheme shall be charged and paid on all letters and postcards for transmission to destinations outside Europe”

Mail to HM Forces and Royal Navy Ships

4.	Paragraph 6 of the Scheme shall be deleted and the following substituted:
“6.-(1) Postage at the rates specified in Part 3 of Schedule 3 shall be charged and paid on all letters, postcards, printed packets and small packets posted in the British postal area, or on board a ship registered in any part of the British postal area while the ship is on the high seas, for transmission:
(i)	to a person on board a ship of the Royal Navy (whether on the high seas or in any part or place outside the British postal area), or
(ii)	to a member of the armed forces of the United Kingdom or of any other Commonwealth country serving outside the British postal area with the armed forces of the United Kingdom or of any other Commonwealth country, being transmitted through a British Forces Post Office or a civilian postal administration in any Commonwealth or foreign country or a US Army Post Office which has agreed to deliver without surcharge letters and postcards at the said rates.
(2)	Postage at the rates specified in Part 3 of Schedule 3 shall be charged and paid on all letters, postcards, printed packets and small packets posted -
(i)	by a member of the Forces referred to in paragraph 6(1)(ii) serving as therein mentioned, for transmission through a British Forces Post Office at which British postage stamps are issued, to a person in the British postal area;
(ii)	on board a ship of the Royal Navy (whether on the high seas or in any port or place outside the British postal area) for transmission to a person in the British postal area.
(3)	Any postal packets for delivery to a person referred to in sub-paragraph (1) above are delivered by the Post Office to the Ministry of Defence, who arrange for their onward transmission.
(4)	Any postal packets referred to in sub-paragraph (2) above are handed to the Post Office in the British postal area, for onward transmission within that area, by the Ministry of Defence who arranges for the transmission of such postal packets to the British postal area.”

Posting on Board Ship

5.	In paragraph 7 of the Scheme, the following new sub-paragraph shall be inserted following sub-paragraph (3):
“(4) Postage at the rates specified in Part 3 of Schedule 2 shall be charged and paid on Small Packets and Printed Packets posted on board a ship registered in any part of the British postal area while the ship is on the high seas for transmission to a person anywhere in the world, unless paragraph 6 of this Scheme applies.”

Air mail packets

6.	In sub-paragraph (b) of paragraph 9 of the Scheme, “20p” shall be deleted and substituted by “21p”.
Airsure packets, Airsure packs, International Signed For packets and International Signed For packs – fees and compensation levels
7.	(1)	Sub-paragraphs (3), (4) and (5) of paragraph 30 of the Scheme shall be renumbered (4), (5) and (6) respectively.
(2)	Sub-paragraph (2) of paragraph 30 of the Scheme shall be deleted and the following substituted:
“(2) Upon every Airsure pack sent to a destination in Europe, there shall be charged and paid the fees specified in Part 2 of Schedule 7 to obtain compensation up to the levels set out in that Part of the Schedule, in addition to postage and any other fees charged and payable thereon.”
(3)	In paragraph 30 of the Scheme, the following sub-paragraph shall be inserted following new sub-paragraph (2):
“(3) Upon every Airsure pack sent to a destination outside Europe, there shall be charged and paid the fees specified in Part 3 of Schedule 7 to obtain compensation up to the levels set out in that Part of the Schedule, in addition to postage and any other fees charged and payable thereon.”
(4)	In renumbered sub-paragraph 4 of paragraph 30 of the Scheme, the phrase “Part 3” shall be deleted and substituted by “Part 4”.
(5)	In renumbered sub-paragraph 5 of paragraph 30 of the Scheme, the phrase “Part 4” shall be deleted and substituted by “Part 5”.
(6)	In renumbered sub-paragraph 6 of paragraph 30 of the Scheme, the phrase “Part 5” shall be deleted and substituted by “Part 6”.

Compensation for certain other postal packets

8.	In sub-paragraph (2) of paragraph 38 of the Scheme, the amount of “£30” shall be deleted and substituted by “£28”).

Postal packets posted on ships or by Forces abroad

9.	(1)	In sub-paragraph (2)(c) of paragraph 43 of the Scheme, the phrase “(except Australia),” shall be deleted in both places where it occurs.
(2)	In sub-paragraph (3)(b) of paragraph 43 of the Scheme, the phrase “(except Australia)” shall be deleted.

Schedule 1

10.	Schedule 1 to the Scheme shall be deleted and the following substituted:
