The Controlled Waste (Duty of Care) (Amendment) Regulations (Northern Ireland) 2004

The Department of the Environment has made a Statutory Rule entitled The Controlled Waste (Duty of Care) (Amendment) Regulations (Northern Ireland) 2004 (S.R.2004 No. 277). The Rule, which is made under powers conferred by the Waste and Contaminated Land (Northern Ireland) Order 1997 (“the 1997 Order”), comes into operation on 9th August 2004.

Article 5 of the 1997 Order introduced provisions relating to the imposition of a duty of care on any person who imports, produces, carries, keeps, treats or disposes of controlled waste. The Controlled Waste (Duty of Care) Regulations (Northern Ireland) 2002 require all those subject to the duty of care to make records of the waste they receive and consign, to keep the records for at least two years and to make them available to the Department on request.

The 2004 Regulations make minor technical amendments to the 2002 Regulations by amending the definition of the European Waste Catalogue and by augmenting the list of persons authorised for the purposes of duty of care to include those holders of authorisations granted under the Industrial Pollution Control (Northern Ireland) Order 1997 and the Pollution Prevention and Control Regulations (Northern Ireland) 2003.
