Form of Application for a Generating Licence
1. Full name of the applicant(s): SEEBOARD Powerlink Limited. 2. Address of the
applicant(s), or in the case of a body corporate, the registered or principal office:
Forest Gate, Brighton Road, Crawley, West Sussex RH11 9BH. 3. Where the applicant
is a Company, the full names of the current Directors and the Company’s registered
number: Peter Stephen Hofman John Weight Company No. 3221818 4. Where a holding
of 20 per cent or more of the shares (see Note 1) of an applicant is held by a body
corporate or partnership or an unincorporated association carrying on a trade or business
with or without a view to profit, the name(s) and address(es) of the holder(s) of
such shares shall be provided: SEEPOWER Limited, Forest Gate, Brighton Road, Crawley,
West Sussex RH11 9BH. 5. Desired date from which the licence is to take effect: 1st
April 1998. 6. The number of generating stations intended to be operated under the
licence (if granted): Two. 7. A sufficient description adequately specifying (see
Note 2) the actual or proposed locations of those stations. Descriptions of proposed
locations must be sufficient to make clear the nature and extent of the proposed development:
Lots Road generating station, 55 Lots Road, Chelsea, London S.W.3. Greenwich generating
station, Old Woolwich Road/Hoskins Street, Greenwich. Both sites are existing sites
and no major development is proposed in either location. 8. A description of how those
stations will, in each case, be fuelled or driven: Lots Road generating station
is gas fired with gasoil as an alternative back-up fuel. The fuel is used to drive
steam turbines. Greenwich generating station comprises gas turbine alternators fuelled
by gas and gasoil. 9. The date when any proposed generating stations are expected
to be commissioned: Both are already commissioned and in use. 10. The capacity and
type of each unit within the generating station (MW): Lots Road comprises 6 of 22-30MW
steam turbine alternators. Greenwich comprises 7 of 11-14MW gas turbine alternators.
11. A statement of extent (if any) to which the applicant considers it necessary for
powers under Schedule 3 (compulsory acquisition of land etc) and under Schedule 4
(other posers etc) to the Act to be given through the licence for which he is applying:
The applicant considers it necessary for the powers under Schedule 3 and under Schedule
4 to the Act to be given throughout the licence for which it is applying for the following
reasons: The applicant intends to enter into a contract (the Power Service Contract)
(PSC) with London Underground Limited (LUL) under which the applicant will own, operate
and finance the generation and high voltage network now owned by LUL for the 30 year
duration of the PSC. The PSC imposes on the applicant obligations inter alia to
supply electricity generated by the applicant at the generating stations to LUL and
to repair and maintain substation properties and the generating stations. LUL will
grant a licence to the applicant to maintain, repair etc and gain access to the cables
forming part of its network. The cables and the ducts within which the cables are
run are either in the land of third parties or in public land. Ownership and operation
of the network for the contract duration will not be possible if properties and/or
rights hitherto own/exercised by LUL cease to be available to the contractor at any
time during the contract duration. The retention and acquisition of property and
rights for the operation of the network are integral to the provision of a comprehensive
railway network. The maintenance of that network may be prejudiced by the absence
of the statutory powers from the applicant’s licence. 12. Details of any licences
held, applied for or being applied for by the applicant in respect of the generation,
transmission or supply of electricity: The applicant is also applying for a private
electricity supply licence. Note 1. Reference to shares: (a) in relation to an applicant with a share capital, are
to allotted shares; (b) in relation to an applicant with capital but no share capital,
are to rights to share in the capital of the applicant; (c) in relation to an applicant
without capital, are to interests: (i) conferring any right to share in the profits
or liability to contribute to the losses of the applicant; (ii) giving rise to
an obligation to contribute to the debts or expenses of the applicant in the event
of a winding-up. Note 2. The description should enable the areas, location or premises concerned to be adequately
and readily identified, by map if the applicant so desires or by any other convenient
means. The following examples of descriptions that might be used are not exhaustive
and are by way of illustration only: the area of premises might be identified by the
name of the customers and/or normal postal address of the premises to be supplied;
described by reference to a named street or road, town, city, village, parish, county
or other accepted boundary, such as a Local Authority Area; or described by reference
to certain other characteristics such as the type of premises or the maximum electrical
demand to be met at those premises.

energy forecast to be supplied and the aggregate estimated maximum demand (see Note
3) for each power band. (b) If the date in paragraph 5 above is on or after 1st
April 1994 then only Power Band A shall be completed and if the said date is on or
after 1st April 1998 then this paragraph will cease to have effect.

8. A description of the system of electric lines and electrical plant by means of
which the applicant intends to supply electricity, indicating which plant and lines
are to be constructed and which are existing plant and lines, and further identifying
any parts of that system which will not be owned by or otherwise in the possession
or control of the applicant: The applicant will supply power generated by it at
Lots Road and Greenwich generating stations, and which will be distributed via an
11kV network owned by London Underground Limited (LUL), use of which will be granted
to the applicant under the terms of a contract to be entered between LUL and the applicant
under which the applicant will own operate maintain and finance the network for the
30 year contract duration. 9. A statement of the extent (if any) to which the applicant
considers it necessary for powers under Schedule 3 (compulsory acquisition of land

for which he is applying: The applicant considers it necessary for the powers under

which it is applying for the following reasons: The applicant intends to enter into

licence to operate the generating stations at Lots Road and Greenwich, London.

Note 3. (a) For premises already receiving electricity for a period in excess of 12 months,
whether from the applicant or anyone else, maximum demand shall be calculated as the
average of the three highest monthly maximum demands in the preceding 12 months; or
(b) for premises not already so receiving electricity, maximum demand shall be calculated
as the average of the 3 highest monthly maximum demands which might reasonably be
expected by the applicant to be supplied in the first 12 months of supply.
