TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State for Transport hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (County of Tyne and Wear) (No. 28) Order 1997” authorising the stopping-up of a length of highway at Rosedale Terrace, Sandyford, Newcastle upon Tyne, in the county of Tyne and Wear, to enable the development described in the Schedule to this notice to be carried out in accordance with planning permission granted to Maurice Gatoff Associates acting on behalf of Addison Motors Limited by the Council of the City of Newcastle upon Tyne, on 4th April 1997, under Ref. DET/01/1725/96.   Copies of the Order may be obtained, free of charge, on application to the Secretary of State at the offices of the Director Planning, Environment and Transport, Government Office for the North East, Wellbar House, Gallowgate, Newcastle upon Tyne NE1 4TD, (quoting GO-NE/97/5038/35/11) and may be inspected at all reasonable hours at the offices of the Council of the City of Newcastle upon Tyne, Civic Centre, Newcastle upon Tyne NE1 8PH.   Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act, or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 6th January 1998, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.   The planning permission granted is for change of use from public highway to access and staff and customer parking for Benfield Motors.
