TOWN AND COUNTRY PLANNING ACT 1990

The Secretary of State for the Environment, Transport and the Regions hereby gives notice that he has made a modified Order under section 249 of the above Act entitled “The Extinguishment of Vehicular Rights (Durham) (No. 5) Order 1998”, authorising the extinguishment of any right which persons may have to use vehicles on a length of Church Street, Spennymoor, County Durham.   The Order contains provisions for permitting the use of that length of highway by vehicles being used for police, ambulance or fire brigade purposes, in connection with the laying, erection, inspection, maintenance, alteration, repair, renewal or removal in or near the said length of highway of any sewer, main, pipe, conduit, wire cable or other apparatus for the supply of gas, water, electricity or of any telecommunication code systems operator, in the service of the Local Authority in pursuance of their statutory powers and duties, or in connection with the retail unit on the corner of High Street and Church Street.   Copies of the Order may be obtained, free of charge, on application to the Secretary of State at the offices of the Director Planning, Environment and Transport, Government Office for the North East, Wellbar House, Gallowgate, Newcastle upon Tyne NE1 4TD (quoting GO-NE/97/5053/35/03) and may be inspected at all reasonable hours at the offices of the Sedgefield District Council, Council Offices, Spennymoor, County Durham DL16 6JQ.   Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the ground that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 26th March 1998, apply to the High Court for the suspension or quashing of the Order or of any provision contained therein.
