The Stopping-up of Highways (Old Barry Road, Llandough, Penarth, Vale of Glamorgan) Order 1998

The Secretary of State for Wales hereby gives notice that he has made an Order under section 247 of the Town and Country Planning Act 1990 to authorise the stopping-up of the length of highway described in Schedule 1 to this notice.   The Order is required to enable the development described in Schedule 2 to this notice to be carried out in accordance with planning permission granted by the Vale of Glamorgan Council on 24th May 1996, under Ref. 95/00876/FUL. The Order will cease to have effect upon the cessation of the planning permission.   Copies of the Order and the deposited plan may be inspected, free of charge, during normal office hours at Penarth Library, Stanwell Road, Penarth, or may be obtained, free of charge, from the Welsh Office, Highways Directorate, Cathays Park, Cardiff CF1 3NQ (quoting Ref. ZC510-5-72-2).   If any person desires to question the validity of the Order, or of any provision contained therein, on the grounds:   (a) that it is not within the powers of the Town and Country Planning Act 1990; or   (b) that his interests have been substantially prejudiced by a failure to comply with any of the requirements of that Act he may, within 6 weeks of 17th September 1998, apply to the High Court for the suspension or quashing of the Order or any provision contained therein. Schedule 1

  The highway to be stopped up is at Llandough, Penarth, in the Vale of Glamorgan. It is shown by zebra hatching on the deposited plan and is part of Old Barry Road, and commences from a point adjacent to the northern side of the entrance to the property known as “Seacrest”, in a northerly direction for a distance of 25 metres and extends from the eastern boundary of the area of highway stopped up under The Stopping-up of Highways (Old Barry Road, Llandough, Penarth, South Glamorgan) Order 1992, eastwards to the kerb-line of the footpath.

Schedule 2

  The development consists of the construction of a bungalow and incorporation of the highway within the curtilage of the property.
