TRANSPORT AND WORKS (APPLICATIONS AND OBJECTIONS PROCEDURE) RULES 1992

THE PUR FLEET (KING’S LYNN) ORDER Notice of application Notice is hereby given that application is being made by the Borough Council of King’s Lynn and West Norfolk (“the Council”) of King’s Court, Chapel Street, King’s Lynn, Norfolk PE30 1EX, to the Secretary of State for the Environment, Transport and the Regions, c/o TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR, for an Order under sections 3 and 5 of the Transport and Works Act 1992, for the purposes of which the following is a concise summary: 1. To empower the Council to construct and maintain within the Borough of King’s Lynn and West Norfolk (“the borough”) a barrage across the creek known as Pur Fleet on the east side of the river Great Ouse in the borough (“the creek”) incorporating sluices, culverts fitted with tide flaps, moveable sections or gates, sills and a walkway and strengthening work, consisting of a latticed structure, on the bed of so much of the creek as is bounded by the existing dam across the creek authorised to be constructed under the Anglian Water Authority (King’s Lynn Tidal Defences) Act 1984, the proposed barrage and the northern and southern banks of the creek. 2. To provide limits of deviation for the works in the creek and to provide that so much of the creek as is impounded by the barrage shall not be taken to be a reservoir; to make provision as to operation of sluices, diversion of flow of water and to provide power to take, pump and discharge water. 3. To provide that the Secretary of State’s consent should be obtained for the construction of tidal works and to ensure that steps are taken to prevent danger to navigation. 4. To enable the Council to make byelaws in connection with the Order; to provide that the limits of the Port and Harbour of King’s Lynn shall cease to include any part of the creek as lies between the western edge of the barrage and the western edge of the existing dam and that so much of the creek as is impounded by the barrage shall cease to form part of a main river for the purposes of Part IV of the Water Resources Act 1991. Notice is further given that: (a) an absolute waiver direction has been given by the Secretary of State, pursuant to Rule 6(4)(a) of the Transport and Works (Applications and Objections Procedure) Rules 1992, and is comprised in one of the documents submitted with the application; (b) a copy of the application, and of all plans and other documents submitted with it, may be inspected, free of charge, during normal office hours until 25th February 1999, at each of the under-mentioned offices and during normal public library hours at the Public Library, London Road, King’s Lynn; (c) any person may object to the making of the Order by giving notice in writing to the Secretary of State for the Environment, Transport and the Regions, c/o the TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR. Such objections must arrive not later than 25th February 1999. An objection will not be valid unless it: (i) is received by the due date; (ii) is made in writing; (iii) states the grounds of objection, and (iv) gives the objector’s name and address; (d) all requests for further information, notices or other documents required to be served upon the applicants may be sent to the undermentioned Head of Legal and Committee Services, King’s Lynn and West Norfolk Borough Council or Parliamentary Agents.
