OPEN SPACE LAND AT CANNING TOWN RECREATION GROUND, PRINCE REGENT LANE PLAYING FIELD AND BECKTON DISTRICT PARK
The Secretary of State for the Environment, Transport and the Regions (“the Secretary of State”), has prepared in draft these compulsory purchase orders which he proposes to make. If made, they will authorise the purchase of land (“the order land”) and new rights over land (“the rights land”) which forms part of an open space as defined in the Act; that is, land laid out as a public garden or used for the purposes of public recreation or a disused burial ground. 2. The Order will be subject to special Parliamentary procedure unless the Secretary of State gives a certificate in accordance with the provisions of section 19 of and paragraph 6 of Schedule 3 to, the Act. The Secretary of State has been asked to certify: (a) under the provisions of section 19(1)(a), that he is satisfied that there has been or will be given in exchange for the order land other land (“the exchange land”) which is not less in area and is equally advantageous to persons, if any, entitled to rights of common or other rights, and to the public, and that the exchange land has been or will be vested in the persons in whom the order land was vested, and subject to the rights, trusts and incidents as attach to the order land; and (b) under paragraph 6(1)(b) of Schedule 3, that there has been or will be given in exchange for the rights, additional land, which will as respects the persons in whom there is vested the land over which the rights are to be acquired, the persons, if any, entitled to rights of common or other rights over that land, and the public, be adequate to compensate them for the disadvantages which result from the acquisition of the rights, and that the additional land has been or will be vested in the persons in whom there is vested the land over which the rights are to be acquired, and subject to the like rights, trusts and incidents as attach to that land apart from the compulsory purchase orders. 3. The order land is described in the First Schedule to this notice; the rights land and the rights which are to be acquired over it are described in the Second Schedule and the exchange land is described in the Third Schedule. On the plan referred to in the paragraph 5 below, the order land is shown coloured pink, the rights land is shown coloured blue and the exchange land is shown coloured green. 4. The Secretary of State is required to give public notice of his intention to give a certificate before he reaches a decision, to afford an opportunity for representations and objections to be made. He hereby gives that notice. Any representations or objections in relation to this proposal should be addressed in writing to the Department of the Environment, Transport and the Regions, at the Government Office for London, Floor 9, Riverwalk House, 157-161 Millbank, London SW1P 4RR, before 29th July 1999, and quoting Ref. LRP31/G5750/02. 5. Copies of the draft compulsory purchase orders, the order maps and plans showing the order land, the rights land and the proposed exchange land may be seen, without payment, during office hours at the offices of the local planning authority: The London Borough of Newham, Town Hall, Barking Road, East Ham, London E6 2RP; Custom House Library, Prince Regent Lane, London E16 3JJ; Highways Agency, Federated House, London Road, Dorking, Surrey RH4 1SZ; and Highways Agency, Room 5/46 a, St. Christopher House, Southwark Street, London SE1 0TE. 6. The Secretary of State may, if he considers it expedient, hold a public inquiry into the matter. R. Neville-Carlé, Government Office for London First Schedule A total of 17,082 square metres of land comprising: (i) 4,917 square metres: part of grassed open space known as Canning Town Recreation Ground, including part of tennis courts, trees, footpaths and public conveniences, south of the A13 (Newham Way), and east of Freemasons Road, London E.16; (ii) 4,840 square metres: part of grassed open space known as Canning Town Recreation Ground, including part of tennis court, trees, footpath and public conveniences, south of the A13 (Newham Way), and east of Freemasons Road, London E.16; (iii) 11 square metres: part of access to Canning Town Recreation Ground, east of Freemasons Road, London E.16; (iv) 7,270 square metres: part of grassed open space known as Prince Regent Lane Playing Field, including part of all-weather synthetic pitch, associated lighting columns, access and part of playground, north of the A13 (Newham Way) and east of its junction with the A112 (Prince Regent Lane), London E.13; (v) 4 square metres: part of access north of the A13 (Newham Way), London E.13; (vi) 23 square metres: part of grassed area of Beckton District Park, south of A13 (Newham Way), London E.16; and (vii) 17 square metres: part of grassed area of Beckton District Park, south of A13 (Newham Way), London E.16. Second Schedule A total of 1,007 square metres of land comprising: (i) 377 square metres: the right to construct and maintain retaining wall and boundary wall adjacent to part of grassed open space known as the Canning Town Recreation Ground, including part of tennis court and footpaths, south of the A13 (Newham Way), and east of Freemasons Road, London E.16; and (ii) 630 square metres: the right to construct and maintain boundary wall in part of grassed open space known as the Canning Town Recreation Ground, including part of tennis court, trees and footpath, south of the A13 (Newham Way), and east of Freemasons Road, London E.16. Third Schedule A total of 18,089 square metres of land comprising: (i) 8,085 square metres: wasteland west of Freemasons Road and north of Russell Road, London E.16; and (ii) 10,004 square metres: part of former school playing field adjacent to Rosetta Primary School east of Freemasons Road, London E.16.
