CHESTER GUIDED BUSWAY ORDER

Notice is hereby given that application is being made by Cheshire County Council (“the Council”) to the Secretary of State for the Environment, Transport and the Regions, Department of the Environment, Transport and the Regions, c/o the TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR, for an Order, under sections 1 and 5 of the Transport and Works Act 1992, for purposes of which the following is a concise summary:
1. To authorise the construction by the Council of works in the City of Chester forming a guided busway on a route commencing at Northgate Avenue east of its junction with Victoria Road, passing through Northgate car park and Northgate Village, then along part of the former Mickle Trafford-Shotton Railway line alongside a footpath and cycleway currently under construction, and terminating in a Park and Ride Site to be authorised by the Order east of Hoole adjacent to the A56 Warrington Road and A41 Greenfield Lane.
2. To authorise the carrying out of ancillary works including road works in Northgate Avenue, Victoria Road, St. Oswalds Way, Delamere Street, the A56 Warrington Road, the northbound slip road on to the M53 motorway and the A55; bridge works connected with the busway or for the diversion of the footpath and cycleway; and the provision of access roads to the busway.
3. To authorise provision for other related ancillary matters including the alteration of the layout of streets; the placing of equipment and apparatus in the street; the temporary stopping-up of streets for the purposes of construction of the works; the carrying out of accommodation and landscaping works; the alteration of apparatus and non-navigable watercourses; the discharge of water in connection with the construction and maintenance of the works; the making of provision with respect to planning permission; the removing, topping or lopping of trees in connection with the construction and operation of the busway system; the entering on land for the purpose of surveying and investigating land; the operation of the busway system; the prevention of obstructions; the making of byelaws regulating the use of the proposed system; and the disposal or franchising of the system.
4. To authorise the compulsory acquisition of land for the intended works and related purposes or the power to acquire new rights only, and to authorise the extinction of rights of way, the taking possession of certain of the land temporarily, and the appropriation of subsoil and airspace of any of the land in a street in which works are to be carried out.
5. To apply, with or without modification, the provisions of certain enactments including the Compulsory Purchase Act 1965, the Compulsory Purchase (Vesting Declarations) Act 1981 and the New Roads and Street Works Act 1991.
And notice is further given that:
(a) In respect of the development described above application is being made to the Secretary of State for deemed planning permission subject to the reservation of certain specified matters for subsequent approval by the local planning authority.
(b) Waiver directions have been given by the Secretary of State in respect of certain provisions of the Transport and Works (Applications and Objections Procedure) Rules 1992 and form one of the documents submitted with the application.
(c) A copy of the application and of all documents submitted with it may be inspected, free of charge, from 30th June until 11th August 1999, at the following places and times:

(d) Any person may object to the making of the Order by giving notice in writing in the period from 30th June to 11th August 1999 to the Secretary of State for the Environment, Transport and the Regions, Department of the Environment, Transport and the Regions, c/o the TWA Processing Unit, Zone 3/11, Great Minster House, 76 Marsham Street, London SW1P 4DR. Such objections must arrive not later than 11th August 1999 and state the grounds of objection.
