NOTICE OF INTENTION TO ISSUE A CERTIFICATE UNDER PARAGRAPH 6(1)(a) OF SCHEDULE 3 TO THE ACQUISITION OF LAND ACT 1981

Land at Chasewater 1. The Secretary of State for the Environment, Transport and the Regions (“the Secretary of State”) has prepared this draft compulsory purchase Order which he proposes to make. If made, it will authorise new rights over land (“the rights land”) which forms part of an open space, as identified in the Act; that is, land laid out as a public garden, or used for the purposes of public recreation, or a disused burial ground. 2. The Order will be subject to Special Parliamentary Procedure unless the Secretary of State gives a certificate in accordance with the provisions of paragraph 6 of Schedule 3 to the Act. The Secretary of State has been asked to certify under paragraph 6(1)(a) of Schedule 3 that the rights land, when burdened with the new rights, will be no less advantageous to those persons in whom it is vested and other persons, if any, entitled to rights of common or other rights and to the public, than it was before. 3. The rights land and the rights which are to be acquired over it are described in the Schedule. The rights land is shown coloured blue on the plan referred to in paragraph 5 below. 4. The Secretary of State is required to give public notice of his intention to give a certificate before he reaches a decision, to afford an opportunity for representations and objections to be made. He hereby gives that notice. Any representations or objections in relation to the proposal should be addressed to The Department of the Environment, Transport and the Regions at the Government Office for the West Midlands, 77 Paradise Circus, Queensway, Birmingham B1 2DT, before 13th January 2000, quoting reference WMR/P/5109/75/1. 5. Copies of the draft compulsory purchase Order and plan showing the rights land may be seen, without payment, during office hours at: (a) The Highways Agency, Project Services Division, room 5/46A, St. Christopher’s House, Southwark Street, London SE1 0TE; (b) The Highways Agency, No. 5 Broadway, Broad Street, Birmingham B15 1BL; (c) Norton Canes Library, Burntwood Road, Norton Canes, Cannock; (d) Burntwood and Chase Terrace Library, Sankeys Corner, Burntwood, Lichfield; and (e) Brownhills Library, Brickiln Street, Brownhills, Walsall. 6. The Secretary of State may, if he considers it expedient, hold a public local inquiry into the matter. Schedule 1—Plan K41-CEH-07 rev A 1. The right to construct a diverted access track and Public Footpath 0.160 (Brownhills), all in 760 square metres of grassland, part of Public Footpath 0.160 (Brownhills), part of access track and part of Chasewater, forming public open space, all north of Brownhills West (shown as plot 7A on the plan) and within the District of Lichfield; 2. The right to divert Public Footpath 0.160 (Brownhills) in 400 square metres of grassland and parts of access track forming public open space, all south of Chasewater (shown as plot 7B on the plan) and within the District of Lichfield; 3. The right to remove a section of stopped up access track and reinstate the land, all in 480 square metres of access track and verge, forming public open space all south of Chasewater (shown as plot 7C on the plan) and within the District of Lichfield; and 4. The right to remove a section of stopped up access track and reinstate the land, all in 280 square metres of access track and verge, forming public open space, all south of Chasewater (shown as plot 7D on the plan) and within the District of Lichfield.
