TRANSPORT AND WORKS ACT 1992

The Secretary of State for Transport gives notice pursuant to section 14(1)(b), (3A) and (3AA) of the Transport and Works Act 1992 (“the Act”) that he has determined under section 13(1) of the Act to make with modifications the Alconbury Airfield (Rail Facilities and Connection to East Coast Main Line) Order 2003 (“the Order”). The Order was applied for by Alconbury Developments Limited, Building 137, North Gate, Alconbury Airfield, Huntingdon, Cambridgeshire PE17 5WX (“ADL”). The Order will authorise ADL to construct and operate railway links between Alconbury Airfield and the East Coast Main Line (“ECML”). The railway works will provide rail freight facilities to serve a development within the airfield site, at Alconbury, near Huntingdon, Cambridgeshire, for industrial and commercial warehousing and distribution. The works comprise rail sidings on the airfield and links to connect these to the ECML, providing both southbound and northbound movements onto and off the main line. In making these determinations, the Secretary of State has complied with the requirements of paragraphs (a) to (c) of section 14(3A) of the Act about consideration of the environmental statement and of representations relating to it. For the purposes of section 14(3AA) the Secretary of State confirms that the main measures to avoid, reduce and, if possible, remedy any major adverse environmental effects are contained in the legal agreement entered into by the applicants and in the planning conditions which he proposes to attach to deemed planning permission for the scheme.
