HIGHWAYS AT HUME STREET AND PINK PASSAGE, AND AN UNNAMED FOOTPATH THAT JOINS HUME STREET AND WINDMILL LANE, CAPE HILL, SMETHWICK

The Secretary of State hereby gives notice that he has made an Order under section 247 of the above Act entitled “The Stopping-up of Highways (Metropolitan Borough of Sandwell) (No 1) Order 2004” authorising the stopping-up of a length of highway at Hume Street, the entire length of footpath at Pink Passage, and the entire length of an unnamed footpath that joins Hume Street and Windmill Lane at Cape Hill, Smethwick, and requiring the provision of new highway shown as stippled on the deposited plan and improvements to existing highways shown as cross hatched on the deposited plan.
The Order as made, will authorise the stopping-up only to enable the development described in the Schedule to this notice to be carried out in accordance with the planning permission granted by Sandwell Metropolitan Borough Council on 10 December 2002, under Ref DC/01/38616, and the approval of reserved matters on 14 October 2003, under Ref DC/03/41344.
Copies of this Order may be obtained, free of charge, on application to the Government Office for the West Midlands, at the offices of the Director, South Eastern Division, 77 Paradise Circus, Queensway, Birmingham B1 2DT (quoting Ref WMT/5107/35/1/37), and may be inspected at all reasonable hours at the offices of Sandwell Metropolitan Borough Council, Sandwell Council House, PO Box 2374, Oldbury, West Midlands B69 3DE.
Any person aggrieved by the Order and desiring to question the validity thereof, or of any provision contained therein, on the grounds that it is not within the powers of the above Act or that any requirement of that Act or of any regulation made thereunder has not been complied with in relation to the Order, may, within 6 weeks of 6 February 2004, apply to the High Court for the suspension or quashing of the Order or of any provisions contained therein.
