TRANSPORT AND WORKS ACT 1992

The Secretary of State for Transport gives notice pursuant to section 14(1)(a) of the Transport and Works Act 1992 (“the Act”) that he has determined under section 13(1) of the Act to make with modifications the Midland Metro (Wednesbury to Brierley Hill and Miscellaneous Amendments) Order. The Order was applied for by the West Midlands Passenger Transport Executive (known as Centro), Centro House, 16 Summer Lane, Birmingham B19 3SD. The Order will authorise Centro to construct and operate an 11km extension to the Midland Metro light rapid transit system, running from Wednesbury to Brierley Hill, via Dudley town centre. In making this determination, the Secretary of State has complied with the requirements of paragraphs (a) to (c) of section 14(3A) of the Act about consideration of the environmental statement and of representations relating to it. For the purposes of section 14(3AA) of the Act he confirms that the main measures to avoid, reduce and, if possible, remedy any major adverse environmental effects are those set out in the conditions that he intends to attach to the deemed planning permission and in the Code of Construction Practice, referred to in his decision letter. As the Order would authorise the compulsory purchase of open space, for which no land is to be given in exchange, the Order will be subject to section 12 of the Act. This section requires that the Order be subject to Special Parliamentary Procedure in accordance with section 19 of the Acquisition of Land Act 1981 and laid before Parliament. The Order will come into force if and when the Special Parliamentary Procedure is successfully completed.
