Land At Holybank Quarry, North Of 14 Mount Pleasant, Harry’s Quarry Land Holding, Part Of Tintwistle Low Moor, An Area Of Land Between RUPP10 and A628 Woodhead Road, Meadow At Bottoms Reservoir Outfall, Land Between A628 To Valehouse Dam, Field East Of Stonebrake Quarries, Tintwistle, Derbyshire
1. The Secretary of State for Transport has prepared this draft compulsory purchase order which he proposes to make. If made, it will authorise the purchase of land (“the order land”), and new right over land (“the rights land”) which forms part of an open space, as defined in the Act; that is, land laid out as a public garden, or used for the purposes of public recreation, or a disused burial ground.
2. The order will be subject to special Parliamentary procedure unless the Secretary of State for Communities and Local Government gives a certificate in accordance with the provisions of section 19 and paragraph 6 of Schedule 3 to the Act. The Secretary of State for Communities and Local Government has been asked by the Secretary of State for Transport to certify:
(a) under section 19(1)(a), that she is satisfied that there has been or will be given in exchange for the order land other land (“the exchange land”) which is not less in area and is equally advantageous to persons, if any, entitled to rights of common or other rights, and to the public, and that the exchange land has been or will be vested in the persons in whom the order land was vested, and subject to the like rights, trusts and incidents as attach to the order land; and
(b) paragraph 6(1)(b) of Schedule 3, that there has been or will be given in exchange for the rights, additional land, which will as respects the persons in whom there is vested the land over which the rights are to be acquired, the persons, if any, entitled to rights of common or other rights over that land, and the public, be adequate to compensate them for the disadvantages which result from the acquisition of the rights, and that the additional land has been or will be vested in the persons in whom there is vested the land over which the rights are to be acquired; and subject to the like rights, trusts and incidents as attach to that land apart from the compulsory purchase order.
3. The order land is described in the First Schedule to this notice; the rights land and the right which is to be acquired over it are described in the Second Schedule; and the exchange land is described in the Third Schedule. On the plan referred to in paragraph 5 below, the order land is shown coloured pink, and the rights land is shown coloured blue and the exchange land is shown coloured green.
4. The Secretary of State for Communities and Local Government is required to direct the Secretary of State for Transport to give public notice of her intention to give a certificate before she reaches a decision, to afford an opportunity for representations and objections to be made. The Secretary of State for Transport hereby gives that notice. Any representations or objections in relation to this proposal should be addressed in writing to the Alison Kinch, Housing, Planning and Urban Policy Team, Government Office for the East Midlands, The Belgrave Centre, Stanley Place, Talbot Street, Nottingham, NG1 5GG by 30 March 2007 quoting reference EMP 1000/119/3.
5. Copies of the draft compulsory purchase order, the order maps and of a plan showing the order land, the rights land and the proposed exchange land are on deposit at the following locations and may be seen there on at all reasonable hours:
