HIGHWAYS ACT 1980

THE A46 TRUNK ROAD (NEWARK TO WIDMERPOOL IMPROVEMENT AND SLIP ROADS) SUPPLEMENTARY (SIDE ROADS) ORDER 2010

THE SECRETARY OF STATE FOR TRANSPORT gives notice that he has

  • 1 considered the Environmental Statement Addendum No. 2 and the comments made in response to its publication and has taken a decision to proceed with the project; and
  • 2 made an Order under Legislation section: sections 12, Legislation section: 14 and Legislation section: 125 of the Legislation: Highways Act 1980, in relation to the A46Trunk Road (Newark to Widmerpool Improvement and Slip Roads) in the County of Nottinghamshire. The Order is entitled The A46 Trunk Road (Newark to Widmerpool Improvement and Slip Roads) Supplementary (Side Roads) Order 2010 and it:
    • a authorises him to —
      • i improve a highway,
      • ii stop up a highway,
      • iii construct a new highway,
      • iv stop up private means of access to premises, and
      • v provide new means of access to premises,
      • vi all in the vicinity of the route of the new trunk road mentioned above; and
      ii stop up a highway, iii construct a new highway, iv stop up private means of access to premises, and v provide new means of access to premises, vi all in the vicinity of the route of the new trunk road mentioned above; and
    • b provides for the transfer of each new highway to the Nottinghamshire County Council as highway authority specified for it in the Order from the date on which he notifies them that it has been completed and is open for traffic.

COPIES of the decision letter and the Inspector’s Report following public inquiry and a copy of the Order and the plans referred to in it have been deposited at the offices of the Highways Agency, 11th Floor Reception, The Cube, 199 Wharfside Street, Birmingham, B1 1RN and at Nottinghamshire County Council, Trent Bridge House, Fox Road, West Bridgford, Nottingham, NG2 6BJ ; Newark and Sherwood District Council, Kelham Hall, Kelham, Newark, NG23 5QX ; Newark Town Council, Town Hall, Market Place, Newark, NG24 1DU ; and Rushcliffe Borough Council, Civic Centre, Pavilion Road, West Bridgford, Nottingham, NG2 5FE ; and at Newark Library, Beaumond Gardens, Balderton Gate, Newark, NG24 1UW ; Bingham Library, Eaton Place, Bingham, NG12 5FF ; Cotgrave Library, Cotgrave Shopping Centre, Cotgrave, NG12 3JQ ; and Keyworth Library, Church Drive, Keyworth, NG12 5FF ; and the Government Office for the East Midlands (GOEM) The Belgrave Centre, Stanley Place, Talbot Street, Nottingham, NG1 5GG, where they are open to inspection at all reasonable hours. Copies of the Order and of the Environmental Statement may be purchased from the Highways Agency at the address given above;

ANY PERSON AGGRIEVED by the decision taken to proceed following the publication of the Environmental Statement Addendum No. 2 and the comments thereon or by the Order who desires to question its validity, or the validity of any provision in it, on the ground that —

  • a it is not within the powers of the Legislation: Highways Act 1980, or
  • b any requirement of that Act or of regulations made under that Act has not been complied with in relation to that Order,may apply to the High Court within 6 weeks from the date of first publication of this notice. On such an application, the Court may suspend or quash that Order or any provision in it.
