New Forest National Park Authority
PLANNING (LISTED BUILDINGS AND CONSERVATION AREAS) ACT 1990 (“THE 1990 ACT”), SECTION 69
ASHLETT CREEK CONSERVATION AREA
NOTICE IS HEREBY GIVEN under the provisions of the Act that the New Forest National Park Authority (“the Authority”) has determined that the area described in the Schedule to this Notice is an area of special architectural or historic interest, and that it is desirable to preserve or enhance its character or appearance. As a result, on 24 September 2009, the Authority designated the area as a “conservation area”.
The principal effects of the designation of this area as a conservation area are as follows:
- 1 The Authority is under a duty to prepare proposals to ensure the preservation or enhancement of the area.
- 2 The consent of the Authority must be obtained prior to the demolition of any building in the area.
- 3 Additional publicity must be given to planning applications for development in the area.
- 4 In carrying out any functions under the planning acts (and, in particular, in determining applications for planning permission and listed building consent), the Authority and the Secretary of State are required to take into account the desirability of preserving or enhancing the character or appearance of the area.
- 5 Six weeks notice must be given to the Authority before works are carried out to any tree situated within the area.
SCHEDULE
(Ashlett Creek)
The boundaries are:
In a clockwise direction, from a point on Ashlett Road at the western boundary of Ashlett House along the boundary between Ashlett House and its associated buildings and the adjoining farmland including land including Ashlett House and its associated buildings, garden and yard. Northeast along the north western field boundary of the two fields running parallel to Ashlett Road to a point where this field boundary joins the National Park boundary and the boundary to the car park and lands of the Jolly Sailor public house and the tide mill. Along the boundary of the car park to a point where it joins the boundary of the tide mill pond to include the land including The Jolly Sailor public house and the tide mill and associated car park. Northwest and then following around the boundary of and including the tide mill pond to a point at the northeast corner of the tide mill. South around and including the mill to a point where the New Forest National Park boundary meets the east façade of the mill at mean low water. Following the New Forest National Park boundary east to a point where it joins the end of the Sailing Club pier at the navigation beacon (white cross), then southwest along the pier to a point where it joins the shore. Southeast along the shore to a point where the perimeter path of the Sailing Club car park joins the shore. Southwest, west, northwest around the boundary of the associated green area to a point where it joins the access track to the Sailing Club. Southwest along the track to a point where it intersects a track which runs northwest-southeast from Ashlett Green to include the land including the Sailing Club, car parks and associated green area to the southeast of the Creek, along the eastern and southern boundaries of the small pond southeast of Seaview, along the south-western boundary of Seaview and The Hollies to include the land including the pond and associated land, Seaview and The Hollies. Southwest from the southern corner of the land of The Hollies along the southern boundary of Ashlett Road to its junction with Stonehills Road, then north across the junction to the northern boundary of Ashlett Road, west along the boundary to a point on Ashlett Road at the western boundary of Ashlett House and its associated buildings.
