TRANSPORT AND WORKS ACT 1992

The Secretary of State for Energy and Climate Change gives notice pursuant to section 14(1)(b) of the Transport and Works Act 1992 (“the Act”) that he has determined to make, with modifications, The Hinkley Point (Temporary Jetty) (Land Acquisition) Order 2012 (“the Order”) using powers in sections 3 and 5 of the Act. The Order was applied for by Eversheds LLP, One Wood Street, London E2V 7SW on behalf of NNB Generation Company Limited (“the Company”).

The Order will confer powers on the Company for the compulsory acquisition of land and rights in or over land adjacent to Bridgwater Bay in the district of West Somerset for the purpose of the construction of a harbour comprising a jetty and harbour related works, which it is proposed would be constructed under powers conferred by the Hinkley Point (Temporary Jetty) Harbour Empowerment Order 2012, made by the Marine Management Organisation, under section 16 of the Harbours Act 1964. Copies of the Order, once made, may be obtained from the Stationery Office or through booksellers.

The Secretary of State has, pursuant to section 14(1)(a) of the Act, given notice of his determination by way of a decision letter dated 16 July 2012, copies of which may be obtained from the National Infrastructure Consents Team, Department of Energy and Climate Change, 3 Whitehall Place, London SW1A 2AW (email: robert.pridham@decc.gsi.gov.uk). That letter gives the reasons for the determination and the considerations upon which it is based; information about the public participation process; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
