LEE GREEN (ZONE LG) CONTROLLED PARKING ZONE

1. NOTICE IS HEREBY GIVEN that Lewisham Borough Council on 30th September 2015 made the above-mentioned Orders under sections 9 and 10 of the Road Traffic Regulation Act 1984, as amended. The Orders will come into force on 12th October 2015 and may continue in force for up to 18 months.

2. The general effect of the Orders will be on an experimental basis:—

(a) to introduce a Controlled Parking Zone (CPZ) to be called Lee Green (Zone LG) CPZ which would include the roads specified in the Schedule to this Notice;

(b) to introduce resident parking places and shared-use (permit holders and pay by phone) parking places into the streets referred to in paragraph (a) above, except where the free short stay parking places, disabled persons’ parking places and waiting restrictions referred to in paragraphs (d), (e) and (f) below are provided. Existing disabled persons parking places and car club parking places will remain unchanged;

(c) to introduce telephone and electronic payments for tickets in shared-use parking places. The service will, for the time being, be run by RingGo and payments for parking will be accepted using a credit or debit card via telephone, mobile telephone apps, SMS or the internet.

(d) to provide free parking places that will operate between 8 a.m. and 6.30 p.m. on Monday to Saturdays inclusive with a maximum stay of 30 minutes and no return within 2 hours in Burnt Ash Road: (i) the west side - 17.5 metres in length outside Nos. 118 to 126 Burnt Ash Road; and (ii) the east side - 24.5 metres in length outside Nos. 123 to 131 Burnt Ash Road;

(e) to provide a disabled persons’ parking place for the use of vehicles displaying a disabled persons ‘blue badge’ permit on the north side of Handen Road, opposite the flank wall of No. 72 Burnt Ash Road;

(f) to remove an advisory disabled persons parking space and replace it with residents’ parking space in each of the following locations:

(i) Handen Road, outside No. 78 Handen Road;

(ii) Hedgley Street, outside No. 6 Hedgley Street;

(iii) Micheldever Road, outside No. 69 Micheldever Road;

(iv) Southbrook Road, outside No. 40 Southbrook Road;

(v) Taunton Road, outside No. 34 Taunton Road;

(vi) Wantage Road, at the side of No. 30 Southbrook Road;

(g) to provide that the existing disabled persons’ parking places in Effingham Road, Micheldever Road and Taunton Road that are currently provided informally would be formalised and included in an Order;

(h) to provide that, other than as specified in this notice, existing disabled persons parking places will remain unchanged;

(i) to reflect existing on-street extents of “at any time” loading restrictions in Burnt Ash Road and Southbrook Road;

(j) to provide double yellow line “at any time” waiting restrictions:

(i) at the junction of Handen Road and Wantage Road;

(ii) the south-east side of the junction of Hedgley Street (north to south arm) and Hedgley Street (south-west to north-east arm) and on the north side of Effingham Road;

(iii) the east side of Wantage Road opposite the flank wall of No. 53 Taunton Road;

(iv) across the access to the road situated at the rear of Nos. 10 to 16 Wimbourne Close (road off of Effingham Road); and

(v) on the east side of Burnt Ash Road, outside Nos. 37 to 49 Burnt Ash Road;

(k) to provide single yellow line waiting restrictions that will operate between 10.00 a.m. and 12 noon on Mondays to Fridays inclusive across drop kerbs, access ways and certain other lengths in Burnt Ash Road, between Effingham Road and Southbrook Road and the streets referred to in paragraph (a) above, to prevent obstructive parking during the controlled hours;

3. The Lee Green CPZ Order will also provide on an experimental basis that:

(a) the operational hours of the CPZ will be between 10.00 a.m. and 12 noon on Mondays to Fridays inclusive;

(b) resident’s permits, business permits, visitor’s permits and resident’s carer’s permits may be issued, on payment of the appropriate charge to a person who is the keeper of a passenger vehicle (having 12 passenger seats or less), certain goods carrying vehicles, a motor cycle and invalid carriages, providing that in the case of:-

(i) a resident’s permit, resident’s carer’s permit or visitor’s permit, they are a resident of a street specified in paragraph (c) below;

(ii) a business permit, they have a business in a street specified in paragraph (c) below;

(c) the properties in relation to which Zone LG permits would be issued are even Nos. 38 to 128 Burnt Ash Road and all properties in Falmouth Close, Wimbourne Close and the roads specified in the Schedule to this Notice;

(d) only vehicles displaying a valid permit showing the zone identifying letters LG may use the resident or shared use parking places (without using the telephone of electronic payment system) referred to in paragraph 2(b) above;

(e) the charge for leaving a vehicle in a shared use parking place via the telephone or electronic payment system would be £0.35 per 15 minutes up to £1.40 for a maximum stay of one hour with no return permitted to that parking place for 1 hour;

(f) the charges for permits will be: resident’s permit:£120 per year; visitor’s permit: £1.40 for a one-hour permit; £10.00 for a book of 10 one-hour permits; £2.80 for a five-hour permit; £5.60 for a one-day permit; and £20 for a one-week permit; resident’s carer’s permit: free of charge; and business permit: £500 per year.

4. Documents giving more detailed particulars of the Orders can be inspected during normal office hours on Mondays to Fridays from the date on which this Notice is published until the Orders cease to have effect, at the office of Lewisham Transport Policy & Development, 4th Floor Laurence House, 1 Catford Road, London SE6 4RU (tel. 020 8314 2215).

5. Where it appears necessary for certain purposes, an officer authorised by the Lewisham Borough Council, may, in pursuance of section 10(2) of the Road Traffic Regulation Act 1984, modify or suspend any provision of the experimental Traffic Orders while they are in force.

6. The Council will be considering in due course whether the provisions of the experimental Orders should be continued in force indefinitely by means of permanent Orders made under sections 6, 45, 46, 49 and 124 of and Part IV of Schedule 9 to the Road Traffic Regulation Act 1984. Any person may object to the making of the permanent Orders for the purpose of such indefinite continuation within a period of six months beginning with the day on which the experimental Orders come into force or, if the Orders are varied by other Orders or modified pursuant to section 10(2) of the 1984 Act, beginning with the day on which the variation or modification or the latest variation or modification came into force. Any such objection or other representations relating to the Orders must be made in writing and all objections must specify the grounds on which they are made and must be sent quoting reference ‘Lee Green CPZ’ to Lewisham Transport Policy & Development, 4th Floor Laurence House, 1 Catford Road, London SE6 4RU. Any objection may be communicated to other persons who may be affected.

7. If any person wishes to question the validity of the Orders or of any of its provisions on the grounds that it is not within the powers conferred by the Road Traffic Regulation Act 1984, or that any requirement of that Act or any instrument made under that Act has not been complied with, that person may, within 6 weeks from the date on which the Orders were made, apply for the purpose to the High Court.
