The following order has been made in relation to the above debtor under the UNCITRAL Model Law on cross-border insolvency as set out in Schedule 1 to the Cross-Border Insolvency Regulations 2006 (“Model Law”), a Recognition Order that (1) the appointment of Russell Crumpler of KPMG (BVI) Limited and Sarah Bower of KPMG in Hong Kong as the liquidators of the debtor and the liquidation proceedings commenced in respect of the debtor pursuant to the order of The Honourable Justice Bannister dated 8 February 2016 made in the Eastern Caribbean Supreme Court in the High Court of Justice Virgin Islands Commercial Division be recognised as a foreign main proceeding; (2) subject to certain exceptions in the orders, commencement or continuation of individual actions or proceedings concerning the debtor’s assets is stayed, execution against the debtor’s rights, obligations or liabilities is stayed, and the right to transfer, encumber or otherwise dispose of the debtor’s assets is suspended; and (3) the applicants have liberty to apply for further relief.
