VARIATION OF THE WOODCHURCH CONSERVATION AREA

NOTICE IS HEREBY GIVEN that Ashford Borough Council (hereinafter called “the Council”) has COMPLETED A REVIEW of the WOODCHURCH CONSERVATION AREA. In carrying out this review, the Council has exercised the powers granted by Section 69(2) of the Planning (Listed Buildings and Conservation Areas) Act 1990. The original designation of the WOODCHURCH CONSERVATION AREA was made in 1996. The review has concluded that some areas should be removed from the conservation area and some areas should be added to the conservation area:

The areas described in SCHEDULE ONE to this Notice are of special architectural or historic interest, and it is desirable to preserve or enhance their character or appearance. As of 21 September 2016 those areas are therefore designated as part of the Woodchurch Conservation Area.

The areas described in SCHEDULE TWO ceased to be designated on 21 September 2016 and are no longer part of the Woodchurch Conservation Area.

The principal effects of the areas being included in the conservation area are as follows:

1) any development within the conservation area and any development outside the conservation area which would affect its setting should preserve or enhance the character or appearance of the conservation area;

2) planning permission is needed for the demolition of most buildings and some gates, fences, walls and railings and doing the work without permission is a criminal offence;

3) the Council must usually be notified in advance if works are proposed to any trees, otherwise doing the work is a criminal offence and a replacement tree may have to be planted;

4) certain householder permitted development rights are reduced or removed, in which case planning permission will be needed.

The principal effects of the areas being deleted from the conservation area are as follows:

1) the Council must usually be notified in advance if any works outside the conservation area are proposed to trees within the conservation area (e.g. cutting back overhanging branches), otherwise doing the work is a criminal offence and a replacement tree may have to be planted;

2) Development which would affect the setting of the conservation area should preserve or enhance the character or appearance of the conservation area.

FURTHER INFORMATION including plans showing the areas added and removed are available for public inspection on the Council’s website (www.ashford.gov.uk/conservation-areas) and during the hours of 9am to 4pm on weekdays at Ashford Borough Council, Civic Centre, Tannery Lane, Ashford TN23 1PL.

SCHEDULE ONE – the areas added to the Woodchurch Conservation Area

(i) 526 sq metres of land to the east of The Mill House, Bethersden Road, incorporating the whole curtilage of that property.

(ii) 1470 sq metres of land to the east and south of Court Lodge Oast, including the whole curtilage of that property.

(iii) 650 sq metres of land at Court Lodge Farm.

(iv) 1425 sq metres of land to the north-east of 39 The Green and the adjoining section of Place Lane.

(v) 380 sq metres of land to the east of the Scout Hut, Place Lane.

SCHEDULE TWO – the areas removed from the Woodchurch Conservation Area

(i) 2370 sq metres of land including Millands Barn, and a section of frontage on to Bethersden Road.

(ii) 2900 sq metres of land to the east of the Grade II* listed Windmill.

(iii) 8590 sq metres of land including all properties on Cherry Orchard.

(iv) 6100 sq metres of land covering properties on the northern part of Bournes Place.

(v) 655 sq metres of land including the eastern part of the curtilage of 2 Garden Close, and part of the highway at Garden Close.

(vi) 1380 sq metres of land to the north of Townland Oast.

(vii) 1280 sq metres of land to the west of Townland Oast.

(viii) 16,050 sq metres of land between 82-120 Front Road, including 80a and 82 Front Road, their curtilages, as well as the road itself.

(ix) 360 sq metres of land opposite 1and 2 Townland Green.

(x) 542 sq metres of land at 25 Lower Road, incorporating the whole curtilage of the property.
