Notice is hereby given that The Borough Council of Dudley (“the Council”) proposes to make the above mentioned Order (“the Order”) in exercise of its powers under Section 18 and Schedule 1 of the Clean Air Act 1993 (“the Act”). It is proposed that the Order shall be made on 19th June 2017 and the Order shall come into effect on 19th December 2017.

1. The general effect of the proposed Order is set out in paragraphs 1.1 to 1.3 below.

1.1 The coming into operation of this Order will revoke the earlier Dudley Metropolitan Borough Smoke Control Consolidation Order 1988.

1.2 The Order will cover the whole of the area within the boundary of the Dudley Metropolitan Borough and will declare the whole of the borough as a Smoke Control Area. The Order will take into account the borough boundary changes and redevelopment of local areas that have occurred in the time since the earlier Order commenced, at which time some properties were excluded from the Smoke Control Area. No properties shall be exempted from the Order.

1.3 The Order will make it an offence to:

i) emit smoke from a chimney in the Dudley Metropolitan Borough, unless it is proven that the the emission was caused by the use of an authorised fuel or by the use of an exempted fireplace used in accordance with the associated exempted conditions, as detailed in Section 20 and 21 of the Act

ii) acquire or sell unauthorised fuel in a smoke control area other than for a building or fireplace which is exempted, as detailed in Section 23 of the Act

2. The offences referred to in paragraph 1.3 carry a fine on summary conviction up to level 3 on the standard scale (currently £1000).

3. Up to and including 12th May 2017 a copy of the proposed Order will be available to view at the Council offices at: 4 Ednam Road, Dudley, DY1 1HL between the hours 9am to 5pm Monday to Friday. The Order is also available to view on the Council’s website: www.dudley.gov.uk/smokecontrolorder

4. Any person who may be affected by the proposed Order may object to the making of the Order by 12th May 2017 by giving notice in writing either by post or email to:
