NOTICE OF DETERMINATION
THE NETWORK RAIL (GLASGOW QUEEN STREET STATION) ORDER 2017
Notice is hereby given under section 12(1)(c) of the Transport and Works (Scotland) Act 2007 (“the Act”) that the Scottish Ministers have determined under section 11(2)(b) of the Act to make with modifications The Network Rail (Glasgow Queen Street Station) Order 2017 (“the Order”) under section 1 of the Act. The Order was applied for by Network Rail Infrastructure Limited (“Network Rail”) of 1 Eversholt Street, London NW1 2DN.
The Order makes provision for the redevelopment of Glasgow Queen Street Station, including the demolition of Consort House, the adjoining canopy over Dundas Street and the 1970's extension of the Millennium Hotel.
The Order includes the construction of a new station building requiring removal of the south and west facades of the existing station building, roofing the station structure and reconfiguring the interior. It also contains protective provisions for statutory undertakers; reciprocal protective provisions for the benefit of the Millennium Hotel to the east of the station; a statement in relation to the treatment for deemed planning permission; and provisions for the environmental assessment of ancillary works through a multi-stage consent process.
The Scottish Ministers confirm that, before making this determination, they considered the environmental statement and the addendum to the environmental statement provided by the applicant and all objections and other representations relating to it, and that the Scottish Ministers otherwise complied with the obligations referred to in sections 8 and 9, of the Act.
The main measures to avoid, reduce and remedy major adverse environmental effects are:
• Development and implementation of a traffic management plan, provision of temporary bus stops and implementation of a communications strategy to mitigate impacts to station users during the construction phase of the project.
• Site specific noise controls included within the Code of Construction Practice to mitigate temporary noise effects during construction. Noise insulation is to be offered to the Millennium Hotel, subject to listed building consent.
• Dust control measures have been included in the Code of Construction Practice to reduce air quality effects during the demolition and construction phases of the project.
Scottish Ministers have, pursuant to section 12(1)(a) of the Act, given notice of this determination by way of a decision letter dated 31 March 2017 to Network Rail and all other parties entitled to such notice under section 12(1)(b) of the Act, a copy of that notice may be obtained from the TAWS Unit, 2E North Victoria Quay, Edinburgh EH6 6QQ. That notice gives the reasons for the determination and the considerations upon which it is based; information about the public participation in the decision making; and information regarding the right to challenge the validity of the determination and the procedures for doing so.
Any person aggrieved by the Order desiring to question the validity thereof, or of provision contained therein, on the grounds that it is not within the powers of the Act or that any requirement imposed by or under the Act has not been complied with in relation to the Order may, within the period of 42 days beginning with the date of publication of this notice, make an application to the Court of Session as regards that validity.
